Hi! We finally sent our package yesterday and of course now Im rethinking every single date and thing that we have provided. We are very confident since we met 3 years ago and we both have been living in Spain for 1'5 years and in the USA for the other 1'5 years (under J1 Visa). 

 

The thing is that maybe we have been TOO HONEST in our Bonafide Marriage Evidence. We decided to add a 4 pages letter explaining our relationship. All is fine but Im worried about the last paragraph. My fianceé don´t see any problem (she is the USC), but of course I might be overthinking. This is what we wrote, beceuase is the truth:

 

"We originally planned to follow the K1 Visa Process but because of COVID-19 and it’s travel bans,
we decided to have a small courthouse wedding in San Diego, CA and apply for an Adjustment of
Status. For us this was a good option because it meant that we wouldn’t need to be apart and
wouldn’t have difficulties seeing each other due to the previously mentioned travel bans. On
07/17/2020 we got married. In 2021, or when COVID-19 will allow it, we plan to have a big
celebration in Spain with both families and friends".

 

We of course are getting married because we want to and because we loce each other. But Im afraid that they can use the last paragraph to consider that we make our wedding earlier only for inmigration purposes.

So it's a CR1 then?.... I share your sentiments sounds like an overkill. 

Although you must tell the truth always when it comes to immigration, however you are not to include information that is unnecessary. But it's done already and it is what it is. Good luck

4 page explanation letter!!!!! Damn. i thought my one page letter had a lot. But hey, every case is different and more is always better than less. i dont see anything wrong in what you wrote, or your timelines

10/12/2020 - Sent new I-765 form

10/14/2020 - New version of I-765 received in Chicago

03/10/2021 - Notice of Deficiency (Missing I-693 Medical Form)

06/25/2021 - Receive Biometrics Appointment Letter

07/23/2021 - Biometrics Appointment at Norfolk VA USCIS Office

07/23/2021 - 485 & 765 statuses changed to "Initial Review"

07/29/2021 - Interview Ready to Be Scheduled

08/13/2021 - Interview Scheduled for September 21st

09/21/2021 - Interview at USCIS Norfolk VA

09/21/2021 - Email saying “card produced and mailed”

09/24/2021 - Approval email sent for I-485

09/28/2021 - Green Card mailed by USCIS (email notification)

09/29/2021 - Green Card delivered to mailbox (also email notification)

10/01/2021 - I-765 rejected because “benefits were obtained via other means”

 

13 Months Total, No Lawyer or assistance besides USCIS website and VisaJourney, you can do it too!!!!

Hahaha thank you, its a little relief to hear that. Its a 4 page because we had travel a lot while in Europe, so almost 2 pages are just dates of flights and destinations,

i used my explanation letter to compact a 6 year relationship (including two CRBAs, and across two continents) into a one page letter. i had to streth the margins and whatnot to make it fit.

Going forward: remember that yes, you need to answer questions honestly, but you do not need to answer questions that have not been asked.

In immigration, providing more than what you are asked for is not always better, on the very contrary. Answer what you are asked, be honest, but be aware that every time you volunteer information you were not asked for, you open yourself to further scrutiny and unnecessary hassles.

It's obvious from that paragraph that you're a real couple that wants to be married. Now that paragraph is totally unnecessary but I don't see how it will hurt.

You’re in the exact same boat my husband and I are in - I think you’re fine. We also got married for similar reasons and are adjusting status. You answered honestly. I hope the process goes fast for you both :)

I would say that given the circumstances you can adjust status perfectly. You are in the US legally, and because of COVID-19 your plans changed... I think you will be ok. I am adjusting status from a F-1 student visa right now.

 

By the way, I'm from Spain too, de Sevilla! Living in DC.

Thank you to everybody! The package is already in Chicago (pretty fast btw, seeing that others have had problems with USPS lately). 

 

So now we the waiting game beggins. I couldn't have done anything with this forum honestly. Thanks!
