Hi All,

 

I am currently petitioning for my husband, seeking a CR1 visa. A few months after we met in 2016, he applied for a B2 visa later that year to come visit me. At the time the interview happened, we were still boyfriend/girlfriend. He put me as the point of contact in DS-160, and was asked by people reviewing her application (not the consular officer) who I was. He stated friend, same as what was put on the DS-160, as there is not a girlfriend option on that form. They did not ask any further questions, and was asked to then wait for her interview with the consular officer. He then interviewed with consular officer and approved for the visa.

 

He has since always complied with the terms of the visa. However his first time entering the US was rough. He was asked to go to secondary inspection, asked to sign some kind of waiver to allow CBP to inspect phone, at which point he was asked who she was coming to see. He said friend to them too. They called me, and asked me if I was expecting anyone and I told them that I was expecting my (then) boyfriend. CBP let him go after they told him, "You are clear to go, your GIRLFRIEND told us she's waiting for you". My husband said the CBP officer was quite friendly during the whole process. Since then, he has entered free of any issues three more times after that first time. 

 

A couple of questions I have are:

 

1) Can this be an issue with the CR1 if they see our evidence of when our relationship started was prior to his B2 issuance, and on DS-160 and interview he mentioned we were friends when asked explicitly who I was?

 

2) How about the CBP experience, can that be an issue with our CR1?

 

3) He noticed that on his DS-160 from back then, he forgot to include his name change upon becoming adopted (age 9). We put his previous names on I-130 and now DS-260, will this be an issue?

 

4) On his job history timeline submitted with the now approved I-130, we found an error with one of the dates. Can this simply be corrected on the DS-260 ?

They are minor issues regarding your relationship status as all that matters is his intent to stay or not and he has proven that he only came to visit. Any time someone comes to visit the US they are not guaranteed entry so the secondary screening just highlighted potential cause for concern regarding immigration intent but ultimately let go.

 

With regards to previous visa forms, as long as there is no clear fraud stated then it should be no issue. Eg. Putting in wrong information with his name as opposed to forgetting to put in a previous name.

 

If they have any further concerns they will request for more information via RFE. Just be honest in filling out the forms. As for the job dates, just correct it, and if they ask for proof just have it handy. I don't think it will be too much of an issue but doesn't hurt to be prepared. They mainly want to know about your relationship being bona fide, financial status and that you have the appropriate forms filled with the correct civil docs.

The fact that he visited and then LEFT, will resolve any issue that concerns you.  No worries.
