For All K1 Visa Petitions that have Stalled at the NVC or Consulate

Unfortunately when the visa is issued it clearly states that it is a non-immigrant visa.  It only allows a single entrance and allows for adjustment.

A fiance is not defined in US Law for immigration status or tax status.  You can be single, married, divorced or widowed.  A fiance is not afforded the same rights or protections as a spouse.  Fiances do not file joint tax returns. A fiance has no rights in probate. A fiance is not untitled to survivor benefits under social security.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

People on this forum are not unsympathetic.  Many have YEARS of experience navigating US immigration, and they want specific laws cited when blanket declarations are made.  

 

And yes, there are people here who have been separated from their fiance/spouse for years.  You can't quantify suffering.

Its these condescending, unsympathetic and "devils advocate" attitudes from people who have been well out of the processes OPs are going though that give VJ forums a bad name.  I've seen and received reply posts from you embodying this exact sentiment. 

 

All I was asking for was for you to cite the specific law you referenced.  No need to be so rude.

 

No two cases are the same, even pre-covid.  Maybe I didn't wait long, but I've been reading VJ for four years, and I've read the stories of plenty of people who have waited for years, even without a pandemic.

And why exactly would I go out of my way to provide anything to you? Nothing you've posted thus far seems to be in a supportive manner; in fact you often times come across as confrontational. 

 

If you are legitimately concerned with the legal basis of this argument, the attorneys who are interested in our cases are listed in the original posting.  Im not being rude.  I'm responding appropriately to your inquisition and tone in this thread. Don't gaslight me. You're well aware of your own intentions. 

 

This post was to advise people in the same situation as me of an option they have available. I'm not sure how this is in any way applicable to you.

You specifically said the current hold on K-1 issuances was unlawful.  You can't back that up with an actual law.  No big deal.

Never said you weren't free to post.  But I'm free to point out your post serves no substantial contribution other than argumentation and further fodder to the toxicity already "noted" in these forums by various "senior members". 

 

Again, if you want to argue the possible legal basis for these claims, feel free to reach out to Attorney Siskind. There is an argument to be made that these actions are unlawful, but im certainly not wasting my time explaining this to someone for whom it doesn't. Even. Apply.

If a fiance was the same as a spousal this would be moot. We all make the choices based on the laws in place at the time and risk accordingly. 

 

Too bad a K1 isn't an immigrant visa  . . . Non immigrant Visas will never have the same importance and Immigrant Visas.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
