Specific Questions Regarding K-1

Hello everyone! I wanted to ask some specific questions regarding K-1 that I could not find when researching, maybe I did not look hard enough. I am just now trying to get started on the process and still have lots to learn.

 

1. I became a U.S citizen when I was 16 when my parents became a citizen and I do not have a certification of citizenship, I just have a passport. On the K-1 form it asks about how I became a citizen and if I have the certificate number, does not putting anything there hurt my application?

 

2. Speaking of passport, my passport (U.S) expires in March 2021, can I still file even if my passport will expire next year? And if so, can I immediately renew my passport after mailing the K-1 form? Or will this mess up the process on their end?

 

3. I know the K-1 visa will take a very long time, but lets say after 3-4 month from filling, would it be okay for me to go where my fiance lives (Turkey) and stay with here there for a few month so we can then come back to U.S together when and if she gets approved? I would need to take a leave of absence from work so I am not sure if that will have any affect?

I don't know about your first question, so I will let someone else answer that. 

 

#2.  As the petitioner, you don't need to worry about your passport as the I129F doesn't ask about it, not does renewing it have any bearing on your petition. Of course, you need to provide proof of your US citizenship and you will either need a birth certificate or passport. The passport is still valid, so there is no issue there. 

 

#3. You are free to visit your fiancée while waiting for your petition to be approved and can even accompany her at the interview/medical if allowed by the embassy. Subsequent trips to visit her would be a positive thing in the sight of the embassy.

Okay that is great to know, so instead of subsequent visit, its just one long visit (2-6 month staying there depending on how much longer this process will take with COVID) that should be okay too then right?

Yes, that is fine. As long as you have permanent domicile in the US.

Keep in mind that you will have to meet the income requirements to prove that the beneficiary will not become a public charge.
