Stepdaughter’s Visa

I am a bit confused and would like some help with identifying which visa is the one that I need for my stepdaughter in the Dominican Republic. I already submitted the I130 and received NOA1. It went to Nebraska. Will her visa vi K3 or CR1?

Timeline

You don't need to worry about that.  The US Embassy will issue the appropriate visa, you don't get to choose.


It will not be a K-3 or CR-1.  Both are for spouses, not stepchildren.  

Did you file an I-130 directly for your stepdaughter with yourself as the petitioner (and not the biological parent)?

How old is your stepdaughter?

 

How old was she when you married her parent?

It will be an I-130 and she would be CR2/IR2.  You don't pick an visa on the form.  K4 (for children) . . . haven't seen one issued in years.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Hi! Thank you for responding. I’m asking because I would like to follow up through here and the correct timelines. Yes, I filled for her online. She is 15 now but we married when she was 5. I haven’t heard back and I filled on 5/31/2020. I would love to have an idea of the timeline. Per USCIS the process is taking from 7.5 to 9.5 months. Any feed back is greatly appreciated.

7.5 to 9.5 for USCIS sounds about right.   Big backlog at the consulates due to covid so that timeline is really impossible to predict at the moment.

Did USCIS send you a receipt?  Has your filing fee been accepted?

 

These are all approximation.  Your time could be longer or shorter.  

 

USCIS will take 7.5 to 9.5 months to approve the I-130.  Then, it can take 2-3 months for USCIS to send the approved I-130 to the NVC to generate a fee letter.  Once you pay the fees, you will need to upload the required paperwork.  How long for this step depends on you and how fast you can get the police certificate. Then, it's about 2-3 months for them to review your documents and schedule an interview.  The entire process from filing the I-130 to getting a visa after the interview is about 15-18 months.  Essentially, expect things to take 6-9 months after the I-130 is approved if everything runs smoothly.

Hi! Yes, I received the NOA1. I filled online and is says it’s been accepted and under review since 7/7. Filling fee? I paid for the I130

extremely happy to say our case is at the NVC. It was sent over on 10/5/2020. Just wondering if anybody knows how the consulate in the Dominican Republic is working the interviews and the timeframes.

Consulates were closed for 5 or 6 months.  There's a huge backlog.  I wouldn't expect an interview before late Spring at the earliest.

Facts are cheap...knowing how to use them is precious...
