Last year my wife arrived in the U.S. on a K1 visa. Shortly after, her 20-year old daughter arrived on a "follow to join" K2 visa. Since arriving, the daughter has been impossible to manage and has disappeared with friends for several days at a time. We have not applied for a change of status for her. My fear is that she will one day simply not return home. My question is, if she does disappear, as her sponsor am I obligated to contact Immigration and Customs Enforcement?

You want to deport your stepdaughter? She’s an adult. At 20 she can do what she wants. Sure it would be polite of her to give you the courtesy of telling you when she will be coming home. But she’s an adult so it’s none of your business what she does. 
 

Are you concerned for her welfare? Is she depressed? It sounds like she may he having some difficulty in adjusting to her new life if this behavior is out of character. 
 

Why have you not applied for her adjustment of status? That’s very cruel.

No, you are not obligated to contact ICE if she disappear.


Has she been in the US for more than 90 days?  Why haven't you applied for her green card?

You are not obligated to contact anyone but it’s strange you and her mom are fine with her being here now illegally. Do you guys want her deported so you don’t have to deal with her?!

You don't have to contact USCIS or anybody.

If she gets a green card with you as an I-864 sponsor, the I-864 remains in effect per its terms.

Legal obligation*

If somebody in your household leaves and never comes back, an ethical obligation exists IMO.

Now if they said "I'm leaving and not coming back", then no such obligation exists.

Another one interested in why you haven’t applied to adjust her status. You did understand this was part of the process for her immigration, correct? If she arrived last year then if I understand correctly, thanks to your (lack of) actions she Is now illegal. Maybe this is why she’s acting up, hm?

In the circumstances just as well he has not applied to adjust her status then he would be on the hook.

Well, he agreed to that initially, presumably. I don’t understand the kind of person who marries someone, gets their child to move countries to be with her, then just abandons the process. It’s not like she’s just arrived. Considering she is illegal as a result of their lack of actions, what do you suppose she should do? She cannot work, she cannot study. At least she has friends.

We do not know if he wanted her to move countries or what the family dynamics are.

 

She is an adult, she is responsible for her actions, sounds like they have tried to deal with the issue but hit a brick wall.

How have they dealt with it? By refusing to adjust her status thus leaving her in an illegal hole that as a K visa entrant she simply cannot dig out of herself?  She has no other option than OP to become legal. Ugh.

Sounds like he’s hoping ice will do that rather than him having to pay the airfare. If she is illegal and unable to work how is she supposed to pay for airfare? He hasn’t mentioned anywhere offering to fly her home, all he’s mentioned is not bothering to adjust her status, love to know the kid’s side of the story too.
