After i booked my ticket to travel to morocco to marry my fiancé' last march, there was the travel ban, delta extended my ticket for 2 years. it s risky to go now let alone chances to quarantine either in there or in  here.

my question, if i marry her via power of attorney, will the American system recognize it as a legit marriage so i can start the procedure?

*Not accepted before consummation. See INA 101(a)(35): "The term "spouse", "wife", or "husband" do not include a spouse, wife, or husband by reason of any marriage ceremony where the contracting parties thereto are not physically present in the presence of each other, unless the marriage shall have been consummated."

but at this time Morocco does have a quarantine and allow only morocco citizens in

and he could not do the marriage there as the embassy is closed to do the first step

in order to marry in Morooc ,,  a person must get "eligibiltiy to marry" letter from US embassy in Casa , take it to Rabat to foreign minister and then get all documents ( meaning a major city trip) transferred to Arabic and then back to her hometown for meetings with police and judge

no way to get this done at this time

buses,  taxis and trains are not in service either

Proxy marriages are unwise, imo.  It would not be recognized by USCIS until it is consummated.  Even then, it could cause issues at Casa.   Better to exercise patience and make multiple face to face visits prior to marriage.

How many visits have had in total? A proxy marriage won’t fly for immigration unless it had been subsequently consummated prior to filing the petition do it makes no sense to do this. Be aware that Casa is one of the most difficult embassies at the best of times. You don’t want to throw in the complication of a proxy marriage also.

Also in case you are not aware you should have plenty of face to face time when it comes to Morocco and immigration.

i had one visit last year when i went to ask her hand for marriage,,and the second trip was canceled due to pandemic.

But unfortunately you don’t control the roll of the ball. With just one visit and then filing for the visa the Casa embassy is very likely to stop the ball rolling and send it back to the start.
