Sent I-864 with my I-130, do I need to redo for NVC?

Hi everyone,

 

I just got my NOA2 for the IR1/CR1 visa process and saw that looking forward I will be required to submit an I-864. I already submitted it with all of the relevant documentation (proof of domicile, tax forms, etc) when I sent off the packet back in October 2019, so I am wondering if the one I sent off is still valid or if I will have to go through and fill out another I-864. Also, assuming I messed up in sending it with the I-130, was it already approved with my I-130 approval (as in, judged to be without mistakes etc), or would it have been just set aside to send to the NVC?

 

I've done a lot of internet searching over the past few days but I can't seem to find any relevant insight on this. I did see that I would potentially have to provide updated tax information as it's now available for 2019, but if the whole of the I-864 was already accepted and judged to be fit, then would I still need it?

 

Potentially relevant information: I am the petitioner living with my spouse in Ireland, we submitted the I-130 packet to Dallas, Texas, so I guess the Texas Service Center? It was forwarded to Potomac Service Center before being sent to the NVC. Hoping to finish things in the US Embassy in Dublin.

 

I'd appreciate any and all information that can be provided. Thanks for reading.

If it is materially different, I would submit a new one.  Additionally, there is no way of knowing if the I864 was actually included in what USCIS sent to NVC.  Back when we were doing our K1, I sent the I134 with my initial submission, but sent another one when my then fiancé reached the consulate phase.

Hi. When we completed our I-130 all this immigration stuff was new to us. We also sent our I-864 with our original I-130 petition at USCIS .

 

Once our petition was approved (no RFE’s) and we were at the NVC stage, we still had to complete and pay for a new I-864 affidavit of support form.
 

I have no idea if they reviewed the one we sent at the USCIS stage or not (it may have just been reviewed as more proof of our relationship).

You will need a new one as the one for the I-130 won't work with the NVC. Others have sent it with the I-130 and still had to resend to the NVC

The I-864 was not needed or even reviewed at the USCIS stage.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Maybe you were reading about AOS when people send the I-485 and the I-130.  Then the I-864 would be needed at that time. :)

Agreed - it was not needed by USCIS and NVC will require a new one.

Since the process now is probably going to take two years or more, your financial situation today, is irrelevant.  People submitting I-864 packages to NVC today, should expect to take updated packages to the interview, as the ones sent to NVC NOW will be outdated by the interview.

Yeah - it doesn't get processed by USCIS with consular processing.  You are lucky they (the contractor) didn't kick back the whole petition.

Are you trying to say that when you get to the NVC stage, it’s going to be two years from that point?

Two years? I guess by the third time I'll be able to fill the forms in my sleep. Is that the new expected timeframe with the furlough and COVID business?

I'm lucky on a few accounts with it to be honest with you, even with having to re-do the I-864. Besides having a few places where I didn't put "N/A" or would have benefited from being more thorough, I have a joint sponsor that would have surely gotten me an RFE or two now that I'm re-looking at her forms. I'm counting my blessings, you can be sure of that!

Sounds about right. We were originally looking to do an AOS before we decided on moving to Ireland so that's probably how the wires got crossed in my pre-research. Lesson learned 😅

No.  The whole process is likely to take two years or more from the time you file the petition.
