Timeline

I just received a rejection notice for the I- 765 that I submitted together with my AOS package last month in July. It said the fee is incorrect and the form is outdated. Since USCIS cashed my check, and I still don't have a NOA letter for my I485 yet.
What do I need to include in my package when I refile the form ? or Do I have to wait until my I485 is processed in order for me to refile the form?

First check if you used the category C9.

 

Then make a copy of your AOS NOA 1, and send it with the form.

Yes , I used a C9 category ( K1 then AOS ) . So I have to wait until I receive a NOA for my AOS to refile the form ?

Hi- If they cashed your check how is the fee incorrect? They would have automatically rejected your entire AOS package if the fee was incorrect. I am assuming you concurrently filed your i-765 with the remaining adjustment status package (i485, i130, i131 etc).  If they cashed your check the fee you paid was correct, and most likely your i-485 and sponsorship petition were correct. 

What does your NOA say in regards to the i-765 you filed. Did you not receive an i-797 NOA for each application you sent? Were they all approved except the i-765? If so as the user above mentioned wait until you get the NOA for your i-485, and include your rejected i765 NOA, and send updated form.

KEEP MIND- THEY ARE RELEASING A NEW I765 ADDITION TOMORROW- so USE THE UPDATED ONE, or YOU WILL GET ANOTHER REJECT
 

I think my I-765 form is outdated. I will send in a new update form along with my NOA for my AOS.
