I've decided to go ahead and try to fill out the 944.

 

I am the petitioner and she is the beneficiary. I believe it's filled out by her and from her POV right?

 

On it, i have to include my 2019 gross income as part of her household (she has no income and no assets btw). I'm (we're?) supposed to meet the 4household minimum threshold of $26,200.

 

I came back to the USA last year may and started working in June. I'd been away since I was a teenager (2008) and so i obviously didn't have any income to file taxes with for 11 years. The money made in the few months I worked last year is a little less than $19,000. I have a letter from my employer saying my salary is about $36,000 plus i also have a part-time job which puts my total income at about $50,000. However, my 2019 tax returns obviously don't reflect this.

 

I don't have any assets here. I think there's a house overseas that has my name on it but i don't have the title to that, just a sale agreement. I'm gonna work under the assumption that I don't have this to put on the form.

 

 

So have I screwed myself by not making the minimum, despite the fact that I will make it this year (i already have actually).

07/23/2021 - 485 & 765 statuses changed to "Initial Review"

07/29/2021 - Interview Ready to Be Scheduled

08/13/2021 - Interview Scheduled for September 21st

09/21/2021 - Interview at USCIS Norfolk VA

09/21/2021 - Email saying “card produced and mailed”

09/24/2021 - Approval email sent for I-485

09/28/2021 - Green Card mailed by USCIS (email notification)

09/29/2021 - Green Card delivered to mailbox (also email notification)

10/01/2021 - I-765 rejected because “benefits were obtained via other means”

 

13 Months Total, No Lawyer or assistance besides USCIS website and VisaJourney, you can do it too!!!!

Make sure you put each other down individually- wife should be first (section A) with "not required to file a tax return" due to her not being in the US in 2019 (I presume) and then you would be next at section B.

I'm gonna work under the assumption that I don't have this to put on the form. The assets are for you both. Again, if neither of you have any skip it- you can't make up what you don't have. FYI bank and savings accounts are assets.

 

 

So have I screwed myself by not making the minimum, despite the fact that I will make it this year (i already have actually). No. I am going to assume you didn't have a joint sponsor and your now wife was approved with your current income based on the I864 you submitted, correct? The I944 looks at the totality of circumstances. Does having assets, a skill set and education benefit her? Surely; but it doesn't mean she will get rejected if she doesn't have these things. 

One thing you do have control over is health insurance so I'm going to ask.. does she have health insurance :)

 

It is also totally not clear if I944 is currently required today; but I don't see how it hurts that you have it completed and id personally rather be safe than sorry. Good luck.

she doesn't have health insurance since she came a few months after my employer's enrollment window. it'll open up again in a few weeks at which point i'll add her.

So for this part (3) i list everyone in the household again that was listed in part 2? this means i also include the minors in the household and indicate they didnt file taxes because they were unemployed minors?

You and or your employer were incorrect; marriage is a qualifying life event and you had 30-60 days to enroll her after you got married. 

 

 

So for this part (3) i list everyone in the household again that was listed in part 2? this means i also include the minors in the household and indicate they didn't file taxes because they were unemployed minors? Yes I would include the minors as they are part of the household and it does not specifically say to not include minors.
