We filed on August 3 and included I-944. Our lawyer advised us to do so as in his words this is a grey area right now and he preferred to play safe by including it. We had all documents compiled anyway. So, my advise to people who are filing now ( and are not in NY or CT) is just to include I-944 with their package  - it won't hurt if its there. Even if USCIS decides they don't need I-944, they will just disregard it and review the rest of the application. On the other hand, if its not there and USCIS decides that they want to see it, that may delay your case.

For cases submitted on or after July 29 and before the reimplementation (that still hasn't been announced) it won't be required later, as USCIS would open themselves up to a lawsuit they know they would lose if they do start requesting it for those cases. There are no links on uscis.gov that currently lead to I-944 PDF and their most up-to-date page says to not include I-944: https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule

That USCIS phone line is known as the "misinformation line." Call it 3 different times and you usually get 3 different answers.

May I ask a really stupid question?  For CR1 this will be needed for my spouse, correct?  He is in Nigeria, I'm in America.  He would have to fill out the I-944 and I would submit it to USCIS, correct?

Not needed for a spousal visa - only for cases that AOS.

No. Immigrant Visa applicants don't need I-944.

 

Regarding the DS-5540, that is not required at this time: https://travel.state.gov/content/travel/en/News/visas-news/update-on-public-charge.html
