goddamn i hate this form 944. but i'm gonna do my best to fill it out just in case. i'm already scratching my head on the first section. they want you to list your household and start with yourself. so then the questions are phrased so its like you're asking yourself these two questions in the 3rd person. are the answers to both of these going to be "YES" ??? i know it sounds like a dumb question but i'm actually confused.

USCIS generally does not update their website over the weekend. The soonest update wouldn't be until tomorrow.

As of now, USCIS hasn't reimplemented it yet: "Dan Hetlage, a spokesperson for U.S. Citizenship and Immigration Services, the DHS agency that processes green card requests, said on Thursday that the agency is "currently reviewing" the Second Circuit's order and "will determine the administrative viability of reimplementing the Inadmissibility on Public Charge Grounds Final Rule where applicable."" https://www.law360.com/articles/1300811

 

When they do, they'll probably announce a date in the near future. Was about to get the documents done but our immigration lawyer told us we can send though it’s very slow and very few USCIS Officer are back according to the friend of hers. I luckily got a SSN that allows me to work. I decided to wait since the lawyer told us I can’t be kicked out as long I got married on time.  I don’t know the negativity to wait before I fill for green card but we are planning to wait instead of going back twice.

Recommend to finish up AOS packet for filing to at least get it into the system. You won't be "going back twice."

Got the SSN as legal alien allowed to work... but they had to consult the USCIS if I was legal here. After you AOS you will go back again after two years to get a green card with no conditions. That’s what am trying to avoid that’s why I said I don’t know the negativity of waiting.

An SSN is not what determines if you can work. The EAD or a green card is what allows you to work.

The "legal alien allowed to work" only means that you are eligible to apply for work authorization.

Check I-9 requirements...an SSN alone won't cut it.

 

The lawyer said you can't be deported as long as you married within 90 days? Wow...that's not right at all. After 90 days, you are overstaying like anybody else that stays beyond their I-94. Overstay is cause for removal. Filing the I-485 is what lets you remain.

The likelihood of actually being put into removal solely due to unlawful presence is quite low, but does happen.

The likelihood of actually being removed so long as you remain in marital union is even lower....an IJ would likely just tell the petitioner to file for AOS. If they agree, then removal can be canceled. But it's a really, really bad experience to go through....

 

One such case of a K-1 overstay by a few weeks that resulted in a really bad experience...

We need to work on ours then. Corona made a lot change for us that even getting married was a challenge. I will call the USCIS tomorrow and gather more information. This is the worst time. 😥😥

Calling USCIS is a waste of time. If you call 3 times, you will get 3 different answers.

This is so interesting. I applied for my education evaluation today but if we don't need i-944 I want to submit mine asap. I have a K1 and K2 and I can't believe I have to do a credit check on my three year old daughter. I am scared to send it without it. Would love USCIS to put a date out for when they are going to implement it again. I will be able to post mine out next week as we get married on Friday.
