Also, the State Department has not updated their website since the public charge injunction from July 29:

On Wednesday, July 29, the United States District Court for the Southern District of New York enjoined the Department of State from “enforcing, applying, implementing, or treating as effective” the Department’s October 2019 interim final rule and accompanying Foreign Affairs Manual guidance related to the public charge ground of visa ineligibility.  The Department is complying with the court’s order and is in the process of updating its guidance to consular officers on how to proceed under the preliminary injunction. In the interim, visa applications that appear to be ineligible under INA 212(a)(4) will be refused for administrative processing to allow for consultation with the Department, including legal review to ensure compliance with applicable court orders.  Visa applicants are not requested to take any additional steps at this time and should attend their visa interviews as scheduled.  Applicants are not required to complete nor should they present the DS-5540, Public Charge Questionnaire.

Even if you ship off the AOS package before the I-944 gets reinstated, my guess (and yeah it's just a guess) is that USCIS can still send an RFE for it later on if they do decide to start using it again. Or ask for it at the interview, possibly?

13 Months Total, No Lawyer or assistance besides USCIS website and VisaJourney, you can do it too!!!!

Exactly it is not re-instated today at least.

Discussed with Officer from USCIS today. No I-944 is required right now. We will be referencing that conversation in our application and submitting today. She told me to submit as soon as possible or else this may change. But today there is no change.

I saw that you were filling out the I-944 before. So you won't include it? It's too late for me to send it out today but I may send it out tomorrow without the I-944 if nothing changes over night.

Filled it all out, and then decided not to send it in. I don’t want it to work against us especially since I filled it out in a few hours! It was Tier 2 officer and I referenced the conversation. 
 

Feeling much better now. I do think we made the right decision, though time will tell!
