N400, lost greencard, expiring drivers license, expired passport

Hi, 

 

I am putting this out there to see if anyone has any advice, but also as a record for anyone else that finds themselves in a situation like mine which is about as daft as it gets and all my own doing!. 

 

I have been living in NC on a 10 year greencard for the past 8 years. I was married to a US citizen but divorced 3 years ago. 

 

My greencard was lost last year and I never applied for a replacement due to the cost, I do have copies/pictures of it. 

 

My UK passport expired 3 years ago. I sent of new application today. 

 

My NC drivers license expires at the end of this month. 

 

I have been on the phone to DMV and USCIS today, it looks like my best bet is to apply for N400 and citizenship. The lady on the phone said once I apply online I can call in and request an interview and they will stamp my passport which I can then use for my drivers license. This all requires me to have my UK passport, so I guess nothing can be done until then. They state 6 weeks but when I spoke on the phone to UK passport people they said a cover letter explaining the situation may speed things up, so I did that and sent it off today. 

 

Does anyone see anything I am missing or pitfall? and does anyone know about this stamping of passport?

Hmm - I’m a long time (36 years) green card holder and apart from the first time I got my license I have never had to show that green card. I’m wondering if your state is requiring everyone to get real Id drivers 

licenses? And I’ve just checked and while you would need this green card and other evidence to get a real ID License I’m not seeing you need this to simply renew a basic drivers license.

 

I think you need to focus on getting your drivers license renewed (since that will impact you if you don’t have one) and your passport renewal, 

 

I’m not convinced you don’t need a valid green card or at the very least evidence that you reported it’s loss in order to apply for citizenship but I might well be wrong about that.

Thanks for your input.

Due to Covid, the dmv in NC are renewing licenses online. When I try to do that it wont let me and tells me to call the DMV. 

I called twice yesterday and had two different people tell me that I would need to bring my passport which included unexpired visa. I believe this comes in the form of my greencard, they both told me I would need to bring that. 

Either way I don't have a passport in my possession right now so I cannot even try until I get that back from the UK. 

Regarding needing the greencard for citizenship application the USCIS told me on the phone I don't have to have it with me. I explained my situation and asked if I should apply for a new greencard, they told me as my greencard still has two years to run on it I would be better off applying for citizenship and having them stamp my passport to show the DMV. 

I also saw a lawyers youtube channel that suggests I will be ok with not having it in my possession when applying for citizenship.

Is your DL real ID compliant (with a star)? If not, renewal cannot be done online.

On May 4, 2020, Governor Cooper extended expiration dates for DMV credentials (such as driver licenses and vehicle registrations; full list below):

  • People whose credentials expired on or after March 1, 2020 and before Aug. 1, 2020 have been given a one-time, five-month extension (from the original expiration date) to renew driver licenses and handle vehicle registrations.
  • Any fines and fees related to expired credentials are being temporarily waived. Customers who already paid a $15 fee for a late renewal in March or April will be reimbursed.
  • This language does not change the original expiration date of the driver license or vehicle registration renewal; it only provides a one-time extension. 

For example: If your registration has a current deadline of March 31, 2020, then the new due date will be Aug. 31, 2020. Next year, the registration deadline will revert to March 31, 2021.
