RFE I-485 Adjustment of Status: No Vietnam Birth Certificate

Hi everyone,

 

I am a Canadian citizen who was born in 1975; my family fled Vietnam during the period of war and ended up as refugees. To my knowledge, my parents did not leave Vietnam with any birth certificates for their children or other documents from Vietnam. 

 

I am now applying for a Green Card and have received an RFE that requests 1) a birth certificate OR 2) a letter from the Vietnamese government confirming that my birth certificate does not exist, with secondary evidence.

 

I have no ties to Vietnam and don’t speak Vietnamese very well, so do not have any idea about how to get this. I don’t even know if my birth was registered. I have emailed various Vietnamese government agencies without any responses (including the Vietnam embassy of Canada and US). 

 

If anyone has been in a similar situation, can you please share your experience and the outcome? Were you able to successfully obtain the letter from Vietnam confirming that a birth certificate does not exist? If not, what did you supply to USCIS that was satisfactory for the RFE response? 

 

I’ve read similar posts from people who have been in this situation, but unfortunately there was never any follow through on their situations.

Time for a call to the local Vn Embassy/Consulate.

 

A letter from mom/dad/sister/brother/caretaker is also going to help.

 

Many countries didn't have a well planned birth record system, especially 3rd world countries where everything was super local and handled locally.

 

I would also research your options for the Canadian Gov't, you had to have been recorded when you entered Canada.
