Changing Last Name on I-751

Hi Everyone

I need some help. My condtional permanent residence card, marriage certificate, social security ,DL and everything else is still in my maiden name. Am i allowed to start using my husbands last name when i apply for the I751 so my green card can come back with my married name?  How can i change all the above documents into my married name.

Did you change your name AFTER your marriage? As in, did you originally keep your maiden name when you first got married and then changed it to your husband's name through the court sometime later?

 

OR

 

Did you take your husband's last name at the time of the marriage?

 

For DL and SS, you need to go to those specific offices and request a name change with evidence of the name change (marriage certificate or whatever legal document shows that).

 

For the GC, IF you changed your name at the time of marriage, then the GC should technically have had your married name. The I-485 asks for your LEGAL name, which would be your married name had you changed at time of marriage. The I-751 also asks for your LEGAL name, so put down the married name and your new GC should be printed with that. Not sure why your conditional GC has your maiden name unless you only changed your name sometime after the marriage.

 

Pretty sure you can't change the marriage certificate.

For some states,  if you don't specify on the marriage license that you're changing your last name, you can only do so with a court order (NY for example).

 

Check if your marriage certificate has a field for "new last name" or something like that. If yes, and you didn't write anything, than you need a court order. If not, than you can just apply for ROC with your new married name.

Thank you for your response. So when we applied for our marriage license i dont remember seeing something about new last name so marrriage certificate came back with maiden name. So i felt since i dont have anything with my married name that means i have to continue using my maiden name. So when we applied for AOS we sent through the marriage certificate and kept the maiden name on the application because, like i said i felt we had no proof and my maiden name is the legal one. Anyway so i applied for everything else using my maiden name, to get things moving. Ive always wanted to use my married name so i applied for a court order recently. They called and said i dont have to go through that route, my marriage certificate is sufficient as proof even though my maiden name is on it...something about custom law.

 

So with all that said, i really want to make sure that my GC has my married name  and wondering whats the best way to do it.? I want my other things SS,DL etc to have my married name? I got married in March 2019 and received my conditional GC in september 2019 so it will expire next year 2021

Do i have to wait for my GC before i change everything else?

Exactly. You just start using your married name, even if it's not on the marriage certificate.

 

If you want to change it right now, you're gonna have to file a I-90, pay the fee, you will receive the same conditional green card with the new name. if you want to wait until ROC, you can. After getting the new green card, you can go to the SS office, DMV and update your name there.
