Hey everyone!

So my wife (US Citizen Petitioner) and I (Canadian Beneficiary) filed on July 16th 2020, NOA1 received July 20th - for I130/CR1.  We initially got Nebraska Service Center and we have been stressing as we havent had any updates or approval thus far.

We finally made the decision to call USCIS today (which took forever to get ahold of a live agent - trick: just say you need to change your phome number and you will get connected to live agent) .  The kind lady told us that our case was actually transferred on July 23rd to Texas Service Centre. We never got any notification.

CALL USCIS AND CONFIRM YOUR SERVICE CENTER...CHANCES ARE IT MIGHTVE BEEN TRANSFERRED WITHOUT NOTIFYING YOU.

We are hoping to get an approval soon. This was hard enough originally but now with a pandemic and travel restrictions, it is much more difficult. I have been fortunate to go visit my wife 2x so far in the middle of COVID. I hope to go again soon.

Praying for us and everyone else in getting approvals and having their cases move along!

In a similar situation to you - we e-filed and got NOA1 from Nebraska, but got transferred to Vermont at some point without notification (probably in September or October). I found out by checking MyUSCIS and reading through the case status section which tells you where your case is being processed.

It's a very frustrating and confusing process, but hopefully we'll start to see more July 2020 approvals soon!

Good luck!

I was told that my case has been transferred from Nebraska to California (which is processing cases for May 2019...) upon query through MyUSCIS Inbox in Nov, but my case status does not indicate the same. It just said "It is being processed at our E-Filed Case Processing Section location". They told me the transfer was done because of workload but I do not understand why a reallocation will add up the processing time instead of reducing... 😔

Hey all,

I have a question. My wife found some information about the I-485 application and we are confused.

My wife is the US Citizen (petitioner) and I am the beneficiary (Canadian Citizen). I am not living in the US at the present time, nor have I ever lived in the US. We filed out I-130 application on July 16th but we are concerned as to whether or not we were supposed to file I-485 (adjustment of status) as well?

We thought that after getting approved after the interview at my consulate (Montreal) that I would go to the US via POE, and then apply for removal of conditions (I-485) at least 90 days before our 2 year wedding anniversary (july 6 2022).

Basically I am just asking if and when we need to apply for the I-485. I am a Registered Nurse here in Canada and I want to start working immediately once I enter the US as her immigrant spouse. We want to ensure we are taking the right steps that can allow me to do this.

Thank you all in advance for your help and I hope we see approvals soon!!

Regards,

Mel

Hello. According to the official websites and VisaJourney when you apply for cr-1 no adjustment of status required. You just send i-130, go through NVC stage and go to your interview where you get your visa. Then at the port of entry they stamp your passport and you should get SSN and EAD within a few weeks. No more paperwork needed except Removing condition 90 days before your 2nd anniversary.

Thank you kindly. So when they stamp my passport at the POE, I will get he SSN and EAD within a few weeks and be able to work? I don't need to apply for these two things?

Thanks

You are welcome, Melissa. When doing your ds-260 ( at NVC stage) you will be asked if you would like to get SSN with your green card. It will be mailed to you.

After getting approved how long does it take at the NVC to Interview?

It depends on many things. How fast you will be able to pay fees. In our case my husband paid IV for CR2 with no problems, for CR1 it kept changing from "in process" to "pay now" for almost weeks. My husband contacted NVC and the problem was solved. But we have delay for two weeks because of it...

After you get approved it's good time to prepare all your civil documents. Request police clearance, scan your documents into pdf file each ( no separate pages of one document), compress them so each document is not more than 2 mb.

Also it  depends on the country where the interview will take place. Some embassies have more cases to work on, some aren't backloged
