HELP...CANT APPLY FOR SSN CARD

Timeline

We went to SSN Office in LAKE CITY, FLORIDA twice already to apply for my SSN Card:

1. First -a week ago before our Marriage the gentleman office employee in SSN told us to wait until after marriage and do it all one time.

2. We went back today to apply for SSN Card with New Married Name and presented the following documents:

a. Passport / Visa

b. I-94 valid until July 28,2007

c. Marriage Licence and Certificate

d. Valid Philippine SSS ID with picture

"THEY TOLD US TODAY THAT WE HAVE TO WAIT UNTIL IMMIGRATION DOES THE AOS STATUS CHANGE"

Please advise any help will be greatly appreciated.

Yep, we had to do the same here. Once AOS happened, we got his SSN, driver's permit, State ID, and later driver's license.

If you have been in the USA for less than 76 days try going to another SSA office and do not mention being married - marital status is an unnecessary item of information that, as you've found out, can cause problems. Assuming that it's Lily who is the applicant, apply in your maiden name and make the name change with the SSA after adjusting status so as to avoid the possiblity of other problems with ill-informed SSA people.

If you've been in the USA for more than 76 days at this point, you do need to have either an EA card or be a LPR to get your SS card.

If you have been in the USA for less than 76 days try going to another SSA office and do not mention being married - marital status is an unnecessary item of information that, as you've found out, can cause problems. Assuming that it's Lily who is the applicant, apply in your maiden name and make the name change with the SSA after adjusting status so as to avoid the possiblity of other problems with ill-informed SSA people.

When we asked the SSA worker if we could go ahead and file in her maiden name she told us that we could not do that either because INS had not changed anything in their computer, and that they could not do anything until after the AOS. :help::help::crying:

Paulily,

If the USCIS has not changed anything in their computer (and they haven't if AOS has not been applied for or has only recently been applied for) then her maiden name is what is in the USCIS computer. That is precisely why I suggested that she should apply using her maiden name.

Either there is some serious mis-understanding between you and the people you are talking with or you've gone to an SSA office filled with numbnuts. Which is why I also suggested trying a different office.

Try PMing I QUIT - if he gets your message, and you are still at less than 76 days, he may be able to help you.

If they didn't accept the application try another SSA office that doesn't have their head up their @ss or talk to the office manager at that office. RM 00203.500 C1 authorizes you to be assigned an SSN base on the K-1 status with the I-94 up until you have been here 76 days. The fact that you are married does not change SSA's policy.

Plus if SSA can verify your status with your maiden name, you can apply with your married name as long as you have proof of the name change, i.e. marriage certificate.

Only the marriage document (foreign or domestic) is needed if it meets the following criteria:

-- The new name can be derived from the marriage document, i.e. bride takes the groom's last name, groom takes bride's last name, compound name (with or without hyphen) of each spouse's original name for either or both parties.

Note: State law must also allow the type of name change wishing to be made

-- The marriage occurred within the past two years

-- The marriage document shows sufficient identifying information, e.g., biographical data

such as age, date of birth or parent's names, and

-- The identifying information matches the information on his/her current Social Security

number record.

The applicant will need to submit an identity document in the old name along with the marriage document if:

-- The marriage occurred within the last two years and has biographical information, e.g.,

age, date of birth or parent's names which does not match our records, e.g., the SSN

record.

-- The marriage occurred within the last two years, but does not show biographical

information, or

-- The marriage occurred over two years ago (with or without biographical information.)

The identity document used to establish the old name must match the name on the current SSN record. The identity document is acceptable even if over two years old or expired.

You can refer SSA office personnel to EM-06064 for current procedures for a name change due to marriage.

RM 00203.210 C. Procedure - Immigration Document as Evidence of Legal Name

When issuing immigration documents, the Department of State and Department of Homeland Security issue them in the person’s legal name. The legal name is also generally the name in which the foreign passport was issued.

When an alien applies for an SSN card, SSA presumes the name on the immigration document is the legal name unless the applicant presents evidence of a legal name change (e.g., marriage) that occurred after the immigration document was issued.

This is in addition to proof of current lawful employment authorized status.

When an alien requests an SSN or replacement/corrected SSN card, SSA will verify his or her documents and current status with the appropriate Bureau of the Department of Homeland Security. If the initial verification is not available through the Systematic Alien Verification for Entitlements (SAVE) system, SSA may need to send Form G-845 for manual verification.

1. Name

e. Applicant Has Changed His/Her Name But SAVE Query Response Shows Old Name

If the applicant has changed his/her name after an immigration document, i.e. I-94, was issued, e.g., married and is now using the married name, but has not obtained a corrected immigration document showing the new name; this is not a name discrepancy for enumeration purposes, i.e. SAVE clearance, if the applicant can provide an acceptable legal name change document to establish the new name.

The 14 day status expiration limit for assigning an SSN and/or issuing a card applies even if an individual submitted his or her application before being within the 14 day period and entered the 14 day period while waiting for his or her status to be verified.

Note: For applications submitted after 01/06/2007 SSA offices can submit an additional electronic verification request, that in most cases eliminate the need for a Form G-845 to be sent. The Brooklyn, NY Card Center has on site USCIS verification.

If your status does not verify through the initial SAVE request be sure that the secondary request has been made and return to the SSA office no more than once a week to see if the SSA office has received a response from the secondary verification request. Be sure to take your document whenever going into the SSA office.

All cards are mailed from Social Security Headquarters in Baltimore, Maryland to the postal address provided on the application.

Thank all of you for your help, Thanks for the links they were very helpful, I now know that we can not get Lily's SSN Card until the NOA1 Part of the AOS. Will not having the card slow up the approval process, as I am filing her AOS , EAD at the same time?

Again TY for the links to the SSA they have loads of useul information alot of what I did not know.

We are going thru the same thing except we are k-3. WE tried two different social security offices and no go. Both offices wanted the AOS or EAD numbers. They told us if we got a letter from a government agency stating why we needed the SSN we could get it. For AOS and EAD you don't need a SSN.

We are going thru the same thing except we are k-3. WE tried two different social security offices and no go. Both offices wanted the AOS or EAD numbers. They told us if we got a letter from a government agency stating why we needed the SSN we could get it. For AOS and EAD you don't need a SSN.

K3s are not work authorised so are not eligible for an SSN without a greencard or EAD unless it is needed for specific government benefits (which ones, I don't know).
