Hello everyone,

my fiancé had a quick question that I could not answer on my own. How long does it take to get a driver license in Texas? Can he get it automatically or does he have to wait til he has AOS approved?

July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

I am based in Kansas, I am not able to apply for my drivers license unless I have my EAD card or green card. You should contact your local DMV. I made an appointment since there is 1.5 month waiting time, my exam would be on sept 11 if hopefully I have my EAD by then. If not I can cancel, I discussed this all with them on the phone so you should be able to make a call.

Per the following document, must at least have a pending I-485: https://www.dps.texas.gov/DriverLicense/documents/verifyingLawfulPresence.pdf Page 3 "Applicants for adjustment of status"

 

Even with that document as a reference, some applicants have encountered resistance from uninformed DPS employees:

Hopefully more Division of Vehicles employees are now aware that EAD is acceptable, since the post I shared above was from 2015.

I assume K1 since moved from that section.  Your fiance can apply as soon as they get here, it's quicker if you get a SSN to apply, They will issue a DL and the expiration date will be like how many days after entry based on I94.  So if you go like 30 days after entry the DL will have expiration date 60 days later.

 

We got Texas ID instead of a DL so my fiance could use it as ID in Texas. It had a short expiration date as well, but worked well when trying to get acounts opened in her name such as bank, etc.  State of Texas recently started only allowing a person to have either a DL or a ID, you can't have both anymore.

 

Once you get you EAD your fiance can get a DL/ID and it will have like a normal expiration date.  Texas  has some kind of reciprocal agreement with Mexico/Canada if you have a commercial DL.

Look at Page 6 ("K-1, K-2, K-3, K-4, L-1, L-1A, L-1B, and L-2," row) of the document I shared earlier. What Allovertheworld said is correct. They can issue DL or ID until I-94 expiration date. You might still encounter uninformed DPS employees, though.

The expiration date will be the one from the EAD.
