Hi,

 

I'm from Thailand. My company is filing EB3 for me. PERM priority date is 03/16/20. As of August 2020, The final action date is 04/01/19, about one year apart. I'm preparing my document to file I-140 and expect to file no later than the end of September.

 

My question is, If while I-140 is pending, and The final Action date moves up to the current or earlier PERM priority date (03/16/20). Is it possible for me to file I-485 while I-140 pending, or Do I have to wait until I-140 get approved?

 

If I know the answer, so I can determine that I will ask the company to file premium processing or not.
