Open the IRS site and read who is not eligible 

you were a nonresident alien in 2019

 

Taxpayers likely won't qualify for an Economic Impact Payment if any of the following apply:

  • You do not have any qualifying children and your adjusted gross income is greater than
    • $198,000 if your filing status was married filing jointly
    • $136,500 for head of household
    • $99,000 for all other eligible individuals
  • You can be claimed as a dependent on someone else’s return. For example, this would include a child, student who can be claimed on a parent’s return or a dependent parent who is claimed on their child’s return.
  • You do not have a Social Security number that is valid for employment.
  • You are a nonresident alien.
  • You filed Form 1040-NR or Form 1040NR-EZ, Form 1040-PR or Form 1040-SS for 2019.
  • An incarcerated individual.
  • A deceased individual.
  • An estate or trust.

So a new immigrant in 2020 will qualify for it. They must use an SSN, though.

If you entered for the first time in 2020, you would not be eligible for stimulus yourself.

One strategy for your situation:  Your spouse can file Married Filing Separately.  Once you get your SSN, you can amend your return to be Married Filing Jointly.

P.S. I also called the USCIS and they didn’t offer any help regarding whether my info has been forwarded to the SSA or not for card production. 

Hi, so mine took 10 weeks after four calls to the SSA. This is what happened to me pretty much. I marked the DS-260 for it to be assigned and it wasn't done.

 

I ended up re-applying and was persistent until i got an appointment. 

 

This seems to be happening a lot lately.

Yep, I marked it on the DS-260 and ended up having to get an appointment.

You mean even if we file with my ITIN for 2019 but file with a SSN for 2020, both me and my spouse will be eligible to receive the advance rebate? Or both 2019 and 2020 need to have my SSN?

If you use an ITIN for 2019 taxes, you won't be eligible for the advance rebate. If you file jointly, neither of you will get the advance rebate.

If you use an SSN for the 2020 taxes, you will be eligible for the tax credit. If you file jointly, you will both qualify for it.

If one gets the advance rebate, the amount of the tax credit will be reduced by the amount received in advance (and any overage forgiven).

 

It's the same total amount either way...just received at different times.

I can't answer that 100%, but that's what I did. I was advising that you keep pushing the SSA until they give you an appointment. I was deemed as an urgent one as I was transferred with my job so needed it. If you have a job already, you should mention that.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hmm, the only problem is I’m not in the USA. Will see what I can do.

How so? Meaning if we file MFS for 2019 and then amend later to MFJ, that will make my spouse eligible for the stimulus based on 2019 return and when I file for 2020, I’ll be eligible then. Is that what you’re getting at?

Yes.  Once you have a SSN, you will be eligible

Filing MFS will allow your spouse to remain eligible.  If they file with you (ITIN holder), then neither will get the stimulus

Regardless, is there anything I can do to expedite the delivery of the SSN while being in my home country?

At present there are limited appointments  for SS cards. To be eligible  you must have a valid job offer in writing  or some medical issue. They only issue only under these circumstances with an in person interview .

The problem with this is the SSA offices are not open to the public right now because of COVID-19 so someone at their customer service center telling you to make an in-person appointment is impractical. I know this because there are MANY naturalization cases right now where Oath ceremonies were completed but SSNs could not be updated by visiting an office. They were advised to mail in their application as all in-person appointments were suspended until further notice. 

I am very surprised that the customer service person who gave you info on the phone said you have to go in-person when I'm sure they too would have gotten the office closure memo for staff 🙄

 

There are major delays with everything because of COVID-19 and it sucks. :bonk:
