Dears, i have a question that my brother applied for F4 visa to me and our brothers in 2007. We waited long time and from a couple of days my brother contacted UCIS and they replied that our application got accepted in 2010. my brother (petitioner) was outside USA so he didn’t receive neither the welcoming letter nor an email from NVC. Is our application rejected ? And if it’s rejected can we make a complain ? Knowing that it has been 10 years since we got the acceptance from USCIS and now NVC is working on 2007 applications.

Your brother should have received an I-797 Notice of Action (NOA2) that said the I-130 petitions were approved for you and your brothers in 2010. On that NOA2 there should be a priority date. If he does not have the NOA2’s I would suggest he contact USCIS customer service to get them mailed to him. He can also look at the Notice of Action (NOA1) that states the petitions were received to find the priority date.

 

The priority date is what you want to follow. Your petitions may have been approved on the USCIS level in 2010, but the petitions will now be sitting at NVC (National Visa Center) till the priority date becomes current. I assume your priority date is 2007 as you state your brother applied for you guys in 2007. Currently, for F4 visas they are working on a range of dates depending on the country. The following are the countries with associated dates:

 

Please keep in mind that your priority date has to become current for NVC to take action. This means your date has to be on or before the date posted for NVC to take action.

 

August 2020 Visa Bulletin - F4 Visa

 

China - Sept 8, 2006

India - Feb 22, 2005

Mexico - June 15, 1998

Philippines - Sept 1, 2001

All other countries - Sept 8, 2006

After all the fees are paid and NVC paperwork is completed NVC will send the petition to your US Consulate or Embassy. You will have an interview at your consulate or embassy. If approved passport will be taken and visa affixed. 

 

Also, please contact your brother to get information and fill out your timeline and home country by going to your profile and selecting ad/edit my timeline. By doing this you can get more specific help.
