It's a decent argument, but the jury will also hear a simple cause-effect argument that will be highly convincing.. if Chauvin didn't put his knee on Floyd the way he did, for the time he did, would Floyd have lived? Pretty easy yes. Floyd could've succumbed later to drug overdose, but he'd not have died right there. They'll be looking at Chauvin's intent and actions (for his charges), so Floyd being doped up and such will only be somewhat relevant but largely the acts of inhumanity will sink Chauvin. I still think he's toast.

First time reading or knowing about  American spectator. This website comes off as conservative version of CNN - not outrightly lying, but smart enough to phrase certain things to lead to desirable rhetoric. I read the medial diagnosis and the complaint(took 2 hours to avoid misunderstanding) According to the comments in the prosecutor complaint, it says this on the page 3

 

"The Hennepin County Medical Examiner (ME) conducted Mr. Floyd’s autopsy on May 26, 2020. The full report of the ME is pending but the ME has made the following preliminary findings. The autopsy revealed no physical findings that support a diagnosis of traumatic asphyxia or strangulation."

 

So the knee thing  may not have been a sole cause of death - no matter how cruel and ruthless is - but then the comment continues: 

 

 Mr. Floyd had underlying health conditions including coronary artery disease and hypertensive heart disease. The combined effects of Mr. Floyd being restrained by the police, his underlying health conditions and any potential intoxicants in his system likely contributed to his death." 

 

In other words, the diagnosis indicates that Chauvin's action may have contributed to Floyd's death.  

 

I appreciate @TboneTX posting this because the article posts real documents from the government, but I don't like how the article sublty tries to assert that the police officers has absolutely no faults in this incident by emphasizing the parts "any potential intoxicants in his system" but not the "likely contributed to his death" and two, it somehow downplays the general malfeasance of kneeling someone's neck. Le'ts not forget Chauvin had past history of overbearing subdue....and of course, as usual, commenters in the news article - not specifically targeting the website itself, people are just lazy in general - are quick to soak up the news without actually bothering to read the supporting documents, going as far as blaming Obama. 

 

I just don't understand how some far out conservatives (like George Parry seems to be) are quick to defend police at the same time denouncing "big governments." Meanwhile, a police officer who was completely appropriate in his action was fired.

Of course, it meets the qualification: 1. Engaging in inherently dangeorus acts (kneeling on neck is def. dangerous), and 2. without regards to human' life.

I sincerely hope the charges stick. People are just so fed up with police power abuse and getting soft-punishment like paid suspension. It's such an unfortunate system that there is no state/federal standard for police hiring but wildly varies within each jurisdiction.

It says 64 is the highest score and 32+ is good. 22 is obviously not good! Still, I m glad to have read it and the supporting legal documents.

Well, but see 1) Parry's analysis and the coroner's conclusion and 2) the transcript with repeated calls for the ambulance.

Some (or many) of the listed sites seem to be chiefly opinion, or analysis.  "Deep delving" doesn't necessarily equate to "fairness," nor can fairness be completely measured in analytical opinion pieces, I don't think.

 

Nevertheless, I think that the Minneapolis officers will have an extremely steep uphill battle.

I'm surprised that no class-action suits have been filed against them for having kicked off the nationwide rioting.

I am pretty sure calling an ambulance is and should be a standard procedure whether one wants to do it or not - not doing so is def. a willful negligence and  might even be considered as "intentional murder" and extreme disregard for one's life, which can tick boxes for 2nd degree murder. Probably not first degree murder since 1st degree needs planning - which this incident definitely isn't. 

 

And as for the analysis, I don't really care for a non-medical professional's analysis when it comes to, "who or what contributed to death?" The autopsy statement, "combined effects of Mr. Floyd being restrained by the police, his underlying health conditions and any potential intoxicants in his system likely contributed to his death." is enough for me.  That's like me asking a hippie ultra liberal junk with zero background in basic chemistry what he thinks about nuclear energy.

He says he is a retired federal prosecutor. I can't find much information on him, however, because Google thinks I keep misspelling Perry as Parry! Arghhhh! 

I am generally skeptical of anyone writing for heavily political websites, left or right.
