NVC asking for joint sponsor in AoS. Do we still need joint sponsor?

Background:
Petitioner get 1,360$/month from Sosial Security Benefit (16,300 /annum)
Petitioner has 80,000$ in stock
Petitioner has house with value 117,000$

We believe that we have enough asset for AoS.


Documents submit 31 May

We got first response 6 August

 

Response #1 :
"Petitioner" does not meet the minimum income requirement to sponsor the intending immigrants for this case. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p. To avoid delays, an additional Affidavit of Support Form I-864 for a joint sponsor may be submitted. FINANCIAL SPONSORSHIP RESPONSIBILITIES: Financial sponsors, joint sponsors, and applicants should be aware of responsibilities when signing an I-864 and the consequences for a sponsored immigrant's acceptance of federal means-tested public benefits. We think we dont need a joint sponsor,

What do you guys think?

Do we still need to file joint sponsor?

 

The petitioner has no other families in USA, so it it will bother to ask friends to help.

The petitioner has no other families in USA, so it it will bother to ask friends to help.

Unfortunately “ your belief” isn’t what matters here .. This is a standard letter sent when income /assets are borderline. The interviewing officer will make the final decision at the interview. You may not need a joint sponsor , but if the IO decides you do, then everything is on hold until you arrange that and submit the documents. 
Im not that confident that you will be approved without a joint sponsor ..though  it will be a decision based on your total circumstances .. but a couple  living on $16k income and having only $80000 in assets isn’t easy in most parts of the US. Good luck

these do not meet the income requirements 

Petitioner has 80,000$ in stock . stocks can become zero overnight 
Petitioner has house with value 117,000$. housing crash can lead to prices falling big or if there is a mortgage its not a liquid asset 

 

you need assets that you can quickly liquidate for cash to show as assets. 

duh

What can be used as assets?

Financial sponsors can only include assets that are convertible into cash within one year and without considerable hardship or financial loss to the sponsor and his/her family. Examples of assets easily convertible to cash are savings, stocks, bonds and property. Sponsors may include the value of their home. 

 

It depends on the officer that interviews you. You meet the guidelines set forth by USCIS, but the officer still has the right to require you to get a joint sponsor.

Yes, stocks can be used. Although the CO will consider the actual cash value of them - presumably the $80,000 is gross (which is what you should list) but may be reduced via taxes to actually liquify those assets.

A primary home can be listed and considered, although its value would not be part of covering any sort of income gap. It's not liquid and would presumably incur a hardship to liquify it.

 

I think having a joint sponsor ready for the interview - presenting their I-864 packet only if needed - would be best here.

Is the petitioner of retirement age? If so, actual living expenses likely exceed their actual income with those sorts of numbers,...medical costs alone can be substantial even with Medicare.

yes, petitioner is on retirement age.

What is CO?

 

I am still in working age, I had my job as a junior chef in New Zealand before COVID lockdown.
However, I am kitchen steward now after lockdown. I am planning to work in USA.

As, it is boring to stay at home.

 

Petitioner is alone, he does not have any other family member in USA.
Can we ask friend to be a joint sponsor? just in case.
However, we dont want to burden someone.

CO = Consular Officer - the person you interview with and makes the visa eligibility determination.

 

Your work history would be a positive factor in the totality of the circumstances.

At the same time, the idea behind the I-864 is that if you are unable to obtain suitable employment, they will be responsible for supporting you. There is no self-sponsorship here (although your assets can be included in the household assets).

 

Any US Citizen or green card holder living in the US can qualify as a joint sponsor.

Joint sponsor needs to fill out form I-864.
