Am I crazy for waiting on No1?

Timeline

My check was cashed may 18th but I have not heard anything yet.

The back of the check was not readable so I cannot even go on line to see if my case is posted.

I called 1 800 375 5283 number for help they took my info and said they would get back to me in 8 weeks :wacko:

I called a second time to see if I could just get my case number but was told to wait for their 8 wk inquiry.

If something happened to my paper work that would set my k-1 back three months by the time I would find out.

Anyone know of another phone number I might call to at least find out if I have a case number?

It seems crazy to now wait another 6 weeks to simply find out if my case is lost or actually in-work.

Just have patience, give it a week and it should arrive. I posted the exact same message a few months ago and the NOA showed up the next day. :whistle:

No longer in the hands of the USCIS, for my wife at least, next up MIL.

Patiente is a virtue, that this process will definitely instill in you. If your check has been cashed, then your NOA1 should be on the way...once your check is cashed it means they've logged your petition and it has been "received" by them. It does seem strange that your check has been cashed on May 18th and you've still not received the NOA1, but that's USCIS for you. There are several here on this board that never received NOA1, and were still approved like the rest of us. :) You might try searching the threads...and contacting one of them for more advice.

If your check has been cashed, then your NOA1 should be on the way...once your check is cashed it means they've logged your petition and it has been "received" by them. It does seem strange that your check has been cashed on May 18th and you've still not received the NOA1, but that's USCIS for you. There are several here on this board that never received NOA1, and were still approved like the rest of us. :) You might try searching the threads...and contacting one of them for more advice.

Hello... I'm still waiting for my I797. I sent out petition (I-130) May 9,'07 (usps priority with green delvry conf.card) ..rcvd dlvry conf card stamped by TSC May 15,'07. Waited a few weeks, check wasnt cashed so I called USCIS cust.svc (same # you have). Due to it being over 15days passed.. I was transfrd to immigration officer (escalated). He looked up our names.. not in systm yet. I was advised to wait longer. Finally I found out check was cashed (bank reprsntv). I called USCIS again. I explaind to customer rep (1st person u speak to) sent out on 9th. Dlvry conf. to TSC 15th..and check cashed..but need help reading and knowing which number so i can see online status.. and still waiting for receipt. I told her prior call was transfrrd to immigration officer and he said call back. My call was transfrrd. Officer helped me, he found our name in system and we talked about WAC# (I said it wasnt clear and I wasnt sure which number it was..there were so many stamps on back of check). He gave me info (actually told me what rcpt letter said online) then said wait longer for NOA1. ...Anyway.. I would encourage you to keep trying to contact them and speak to officer.. It seems that not all reps and officers are the same. You may get one that will work with you.. Especially if you mention Date you sent. Date confrmd Service Ctr recvd. Check was cashed.. and need help reading number. Ask if they can look you up in system. Also that you would like to take advantage of the case status search online while you wait for notice.

I really cant stand the inconsistency in the system and also when I read a notice stating they recvd petition and notice was mailed June 5th. Whats up with that.. Mail isnt coming by plane, train, car, or ship.. neither by pony... I think the mail carrier is walking all the way from CA to TX. (oh yeah.. petition went frm TSC to CSC.. just like waiting in a long line.. and reach the front only to be sent to another line next to you that you saw growing longer and longer.. now your at the end of that new line... ok. whats wrong with this picture :wacko:

Lets continue to keep up with timeline.. and posting if any info or updates. It helps a alot.. It helps in the wait.. makes ya feel like youre not alone in all this. Its coming... really.. it is. Sometimes when this gets to me.. I just reflect and look at how far my husband and I have come from the first day we met. We have and still are moving forward and closer together. Never would have imagined this a couple of years ago.

I remember how excited I was when I saw that the check was cashed. The letter will be sent out within a few days and then it will arrive at your house post haste. I probably wouldn't call the USCIS and bother them. Please remember that the folks at the USCIS have a huge workload so it can take a while. But the truth is, they're moving pretty fast recently. Our documents were processed just 45 days after being received! ^_^

But the thing many people may not know is, in 2006, the USCIS changed their process for approval. As I understand it, all K1s are sent to the California or Vermont service centers now (rather than being processed at the location where they are received). So there may be a little delay as the documents are sent from your receiving center to the correct K-1 center. But the truth is, it will be more than worth it when your I-129F is approved in weeks rather than months.

The USCIS has a call center whose job is to answer phone calls so you're not bothering anyone. Follow what others have said and call to get your case #. They are messed up with NOA1 and 2's as of late. I got my NOA2 1.5 months after having been approved and only after having called numerous times.

As you have discovered, the 800 number is so useless as to be essentially worthless. In fact, USCIS would probably be doing all of us a favor if they removed the 800 number entirely rather than give people false hopes that they might actually be assisted on a timely basis.

In your case, there is probably little that Customer Service can do without you supplying them the Case Receipt Number....... which is what you need.

I know a method that might work but it is a long shot. Immigration attorneys in this situation will go to the local USCIS office and try to "back door" the information through their contacts there. This would cost you money for an attorney. However, you could try the same method yourself without an attorney. You would go to the local USCIS office in your city, take a number...... wait to be helped......... and then desperately hope that you get a helpful USCIS representative behind the counter that is willing to hack into the USCIS computer database to find your Case Receipt number on the basis of your photo ID and a copy of the fee check that USCIS cashed. (Of course, you should bring these).

I say again this is a long shot. One USCIS rep at the Customer Service 800 number told me that they can not look up pending cases by last name on their database. They need the Case Reciept Number. On the other hand, immigration attorneys are able to find their clients' Case Receipt Number so there must be some way of doing this in the system.

As others have suggested, waiting might not be a bad option since you know that your fee check was cashed. I know this sounds terrible and gives you and your fiancee no peace of mind. Trust me, many of us here know exactly how you feel.

Just an update.. maybe not any changes..but I called USCIS.. and transfrrd (escalated call) to immgrtn officer. Ive done this a few times in past 1 1/2 months. This officer was very friendly..and didnt just tell me to wait longer but explained more and didnt just read to me what I already can see regarding letter online saying rvd check.. sent out NOA1. . He looked into it and said there are 1000's in mailroom.. and mine is not shown as Actually being sent out yet..but it will. Said to give it 30 days from time check was cashed (stamped June 5 at CSC..due to transfr from TSC that rcvd I-130 May 15 :wacko: ) and to call back July 5+.. if I had not rcvd NOA1 by then. He said to explain exactly what I told him and also what he said. Because he made me feel like I was more than just some number in a crowd and only one who said it has not actually been sent out yet from mailroom.. it made me feel a little better and able to wait a little more. Good customer service makes a difference! As I say in being in retail..If it werent for the customer..I wouldnt have this job. So I try my best to treat people the way I would want to be treated.. and that goes for everything. Alhumdulilah!!!!
