I have a question about AP and getting a new I-94. My wife would really like to get her drivers license here in California. DMV is givng us a very hard time because she is in "admintstrative status" She came her on a K1, we got married, filed the AOS and AP papers. Today we received her AP papers and are now wondering if we take a trip to Mexico or Canada will they give her a new I-94 with more than 30 valid days on it? DMV in California says it will take a valid I-94 but it must have over 30 days remaing on it. We did not know this or we would have rushed to get her drivers license when she first got here. But we waited too long and by the time we went to the DMV, she only had 15 days remaining in valid status so they refused us her license.

What does everyone think? May this work, and allow my wife to get her DL?

racerx,

When my wife used her AP her I-94 was marked for a 1-year stay. I don't know if that is always the case.
