Im sure it'll be a pain in the but to get everything for green card and work even after she's here, but, then we'd at least both be able to work on it together. right now with time difference of 12 hrs and our work schedules, and my side gigs we're left with much less time to talk and get this all done. Additionally, Im having to make all the calls and everything during work breaks.

My first question would be have you fulfilled the requirement for having met in person with in the past 2 years?

 

We sent our I129F packet this last March - I can honestly say from my experience the more difficult part comes with preparing the rest of the packet (copies of documentations, proof of meeting in person etc) - once you go through the I 129F it's pretty straight forward but the rest of it does take time to put together.

yes. We've met 3 times for +/- 3 weeks each visit in the past year and a half. 

 

Also, gotcha on the prepwork for the post I-129f packet. I think we are now in he process of gathering all documents we think are important, I know well have new ones we need to get like medical, etc. but were trying to gather anything we can currently get.

Forgot to ask what the age difference is between you two.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

That's exactly what I was thinking when I filed mine. Yeah it'll be a pain but at least we got the process started of being together since we can't get married easily at all. We have twelve hours difference too

The medical comes later - Sorry for the confusion. I mean documents that you will send with the I129F - things like proof of having met in person, divorce decree if you or your foreign fiance were married previously, intent to marry, birth certificate, etc. Sometimes the proof of ongoing relationship can take time to assemble should you choose to include photos etc. I wish you good luck. This has been a helpful community for me - I also highly suggest looking at the info available on USCIS. They have filing tips and instructions for the I129F form as well.

Wonderful age difference.  Large disparity can raise red flags, except in the Philippines and perhaps a very few other places.

I did a K1 for my wife from Thailand, I helped a same sex couple a few months ago get their K1 filed, and I literally last week helped my friend I've known for over 30 years review his 129 for his fiance from Thailand also, and he just mailed it in. About 5 days ago. I can recommend a good service in Bangkok if you need help preparing the petition. Friend of mine and his wife who used to live in Vegas moved there and run a law firm doing K1 and CR1 visas all day long. I didn't use them myself but if your concerned they can help you with the whole process thru AOS for a reasonable price, and I have refered 3-4 people to them in the past 4 years and will vouch for them as one that is very good at what they do.

I am willing to help you out with all the tips and tricks to the process. Where to get cheap vaccinations, help with police clearance certificate, so you only pay about 200 baht instead of the hustle they will get you for like 2000 baht for the so called " Express" service. I am pretty familiar with the process in Thailand and am pretty current on how things are going there. I will be there in October actually ( benefits of having a Thai spouse with our marriage registered in Thailand, Thai bank account, drivers license etc.) I spend quite a bit of time there, and actually am looking at some properties near hua hin to get in on now before the prices get too carried away. Feel free to message me and I will send you my phone number, and can at the minimum give you some pointers and at least put you in touch with a reputable company that can help you or not depending on what you want to do. I don't think you have a complicated case, and can probably handle it yourself, but if you feel more comfortable with help, I can get you quality help at a reasonable cost. Then, when you get her here, fly out to Vegas and I'll even marry you and get your certificate in under an hour! LOL. Good luck with whatever you decide, but I'm willing to help.

I don't think any of things you said point to a difficult process. Her time in England on a student visa is a non issue, they might ask her why she was there and she will just say the truth, pretty simple. The only thing that she will likely need a police report from England, I don't know if she can get it from the embassy. 

 

I would just use her father's current name. I don't see this as a big problem.

The I-129F petition fee is not increasing.  It is the subsequent fees that are increasing.  There is no way for you to avoid those increased fees if you go with the K-1, because even if you send off your petition tomorrow, the AOS and related fees will not be paid until after you get married.
