Then how immigration officers will judge totality of circumstances under public charge rule. I am so confused now

They will not verify it from 5540. They get all the required information from AOS- i-864

The embassy emailed us back after we put in an inquiry saying they need visa photos and a new medical. How do we go about getting the second medical exam? The embassy has my husband's passport. As far as the photos are concerned, how do we send those to the embassy. Any clue? I emailed them back and yet to get an answer.

Email or call the embassy and explain about retention of passport.
Contact details are on the link for Islamabad. visit you embassy website otherwise

Does anyone know how long the visa status remains "Administrative Processing" after you have received the visa approval letter at the interview

It is very normal to take 2 week even.. but usually it takes 4-5 working days.

That is good to know. So it means they are not judging on the basis of criteria like age, assets, sponsor's use of previous benefits  etc?

They evaluate public charge risk based on totality of circumstances.  So anything is potentially included.

But how they would know the sponsor was taking benefits or no? or how much debt is on sponsor etc etc. That is why DS 5540 was started .  Makes sense?

They will look at the sponsor's income.  If they qualify for public benefits, it will be low.

Also I have heard, from now on, public charge determination will be according to 1999 law. Only cash benefits and SSI will be considered public charge. My question is when it will start implementing?

Incorrect.  The sponsor's income and totality of circumstances have (and will) be considered.

Then why there is a noise that this rule has been stopped? You are wrong. Totality of circumstances is a term coined by Trump adminstration. From now on, since all Trump policies haver been reversed, totality of circumstances will be removed too. I know that there is always a public charge rule, but it was not as broad as was done by Trump

No, that term was not coined by the Trump administration.   The public charge rule of inadmissibility is not new.

How many applicants were declined based on public charge  before Trump era and during Trump era? I do not think you know the stats. It was because Totality of circumstances ( Age, education, employment, assets etc) were not there and people used to be declined on cash benefits and SSI . And usually affidavit of support was more than enough to approve the case
