Beneficiary only. I-944 is only for beneficiary.

Help Please!!

 

I received an email that an RFIE has been sent to me and I think it’s the I-944. However, my husband’s tax return income reflects an amount below the poverty threshold because he filed taxes within 6 months of starting his new job. He actually makes over the 2 household threshold of $21,550 but how do I prove this? I already have paystubs reflecting year to date and letter of employment stating the annual income. Will that do? (This is for the I-944)

10/05/2020 - Recieved physical reciept notices in the mail

10/06/2020 - Sent I-765 to Chicago Lockbox using UPS

10/09/2020 - Package was recieved by USCIS

10/30/2020 - Recieved text notication from USCIS with reciept number for I-765

Then your husband doesn't need to include any tax returns/paystubs/employment letter. The 944 is for you only. The only part where you can include him is under your assets if the two of you live together so you should be good :)

Thanks @RobertKim!!! Well, we submitted it at the end of July, but got rejected due to outdated I-485 form so we resubmitted in August. Wow really? When did you submitted everything? Hopefully you heard something back soon but just know some people in the AOS July filers thread also haven't got their biometrics appointment.

Rejected package received - 08/05/2020
Resubmitted AOS Package - 08/07/2020
Text message from USCIS received - 08/31/20

RFE for Form I-944 because I didn't submit it, due the Injunction of the Inadmissibility on Public Charge Grounds Final Rule. It changed and had to submit Form I-944.

USDHS received it on 10/19/20

In part 3, Item 1, household members annual gross income from the most recent federal income tax returns is listed. Her husbands income can (and should) be included here.
 

From the instructions “We will consider your household annual gross income, which includes your annual gross income, and any additional gross income from your household members listed in Part 2.”

Your husband has to anyways send his transcript for I-864. I-944/I-864 is combined and needs to be sent with I-485. So you are including his transcript. I-944 instructions says don't submit duplicate docs.

I don’t think anyone can answer authoritatively on whether that will be sufficient as the form is pretty new and no one is sure how lenient they’re being (they were fairly aggressive with rejections earlier while it was active).


Depending on the time you have to submit the 944, you could consider waiting until Jan 1 to file taxes with his new income, and then submit that number. There’s even a chance the form will not be required by then (but weigh that against the downside of stalling your application process while you wait to submit).

I said nothing about documents, just correcting the idea that the husband can “only be included” on the assets section, that’s not correct.

Oh, yeah you're right. I completely forgot about that part as I have not looked at the form in a while.

Thank you guys, I also spoke to a lawyer who stated that being that the I-944 is being reviewed at a case by case basis (the wealth test), they look at multiple factors like age, education, bank account history, credit history etc. With that being said, I was told to just provide the sufficient evidence to support the income amount and I should be good. And who knows, maybe it will no longer exist by next year as you said.

I submitted towards the end of August and I had my biometrics including AOS a few weeks ago. Still waiting for an RFIE for I-944 though.

 

Just checked my status wondering about RFIE and instead it was finally updated to "Case Was Updated To Show Fingerprints Were Taken"
