Yes. I-130A needs to be submitted along with I-130.

My paralegal told me not to, but I still sent the I130A based on what I read on uscis.

That's such a wrong thing your paralegal told you. I-130A is a required form with I-130. Glad you sent it.

If he paid the full I-485 fee, then filing I-765 is free. Filing I-131 is also free. https://www.uscis.gov/system/files_force/files/form/i-485instr.pdf "If you properly file Form I-485 and pay the required fees, you may file Form I-765 and Form I-131 without paying additional fees. You may file these forms together, or if you choose to file Form I-765 or Form I-131 separately, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed and paid for Form I-485."

Is this going to cause a delay on the I- 765 , I am asking if USCIS will consider the initial PD for the whole case or the EAD itself will be allocated a new PD.

Ikr. Thank u. I couldn’t understand why & she kept trying to prove her other cases were sent without.. thank god for the internet & places like vj where we can read & learn.

Just to confirm, you are adjusting as a spouse of either US citizen or LPR. Correct?

The I-765 will have new PD. 8 CFR § 103.2(a)(7)(ii): "A benefit request which is rejected will not retain a filing date."

Yes it was, dated the October 13. For the I-944.

At least that was the only thing that we were missing.

I think, and correct me if i'm wrong, if its an RFIE it will come from the National Benefits Center but if it's a biometrics appointment, it will come from a Application Support Center.

The envelope for biometrics notice also says National Benefits Center.
