Maybe they will forget I didn't hand in I-944 and I will slip through the cracks. Wishful thinking I know!

Hey! No updates for me yet. Good to hear they are actively reviewing your case. I sent my birth certificate translation by a friend who works as a paralegal no seal required just signs a document that she is fluent in Spanish Signed. I’ll let you know if I get anything back. 

 

If you don’t mind sharing- did you initially submit any tax docs?

I got an email from the National Visa Center today requesting affadit of support and DS-260 with applicable fees.

Is this right? We submitted an I-130/I-130A online and mailed in the I-485/I-761/I-131/I-944/I-864/G-1145. My wife is in the US from a K1 Visa.

If she's in the US from a K1 Visa, why did you file I-130 and I-130A. Did you get married after the 90 days?

No I-130 needed. You just wasted 535. You should withdraw the I-130 application. I wish you read the first page of this topic before you filed.

 

What did you choose for the AOS category? (a) or (c)?

 

If you chose (a), there's a high chance your current AOS will be denied since there shouldn't be a I-130. The correct for K1 is (c).

I picked (c) there on the I-485. Need to figure out how to withdraw it...

I did not submit tax docs. Only IRS transcripts. And even then, I may have accidentally submitted the incorrect ones - my own, instead of my spouses (we file taxes jointly). It occurred to me I may have accidentally submitted the wrong transcripts a month after I sent the paperwork over because I was cleaning paperwork out. I need to really sit down and review the RFE though, since it was kind of lengthy and I skimmed over it briefly.

You can try calling USCIS to see what you need to do.

Thank you both for the help. I did get through, they asked me to write a letter to the service center, and try for a refund although I am not expecting it. Writing a letter isnt required but a good step since my wife does have status.

hey everyone, i know a guy  who field in the end of July, he get the package back for an error in for i485 early Sep , he send it back again and they send him form i 765 for out dated form and wrong fee, he's a k1 visa AOS filer category C09

Ok I see. I submitted our tax docs but we file jointly as well so not sure how that will play out. No updates yet on my end.

He must use August 25 edition: https://www.uscis.gov/i-765 "Edition Date 08/25/20. Starting August 25, 2020, we will only accept the 08/25/20 edition. You can find the edition date at the bottom of the page on the form and instructions."

 

If he paid the full I-485 fee, then filing I-765 is free. Filing I-131 is also free. https://www.uscis.gov/system/files_force/files/form/i-485instr.pdf "If you properly file Form I-485 and pay the required fees, you may file Form I-765 and Form I-131 without paying additional fees. You may file these forms together, or if you choose to file Form I-765 or Form I-131 separately, you must also submit a copy of your I-797C, Notice of Action, receipt as evidence that you filed and paid for Form I-485."
