It really all depends on where the RFEs are coming from, and how much USCIS planned for this. If the lockbox folks were proactive and making notes about which applications were missing 944 as they were processing them, then it should be relatively easy for them to send out the RFEs and we'll all have them in a few weeks.

 

But if the apps are going to require re-review involving either local offices and/or NBC (which prepares a lot of documents for local offices), both of those are running understaffed and overworked, and things are going to take quite a while.

 

Even though the furloughs were avoided, USCIS still made operational cuts:

The above is likely responsible for the USCIS portion of the lag on mailed NOAs (that's where they're shipped from). Throw in postal service delays and I predict we're all going to be waiting at least a few weeks but likely longer.

 

There's a separate bill that just passed the house and is expected to clear senate and receive signature (H.R. 8337) that provides additional funding to USCIS and that could potentially help things along but we'll see. 

 

Honestly we'll be excited if we get a biometrics appointment before the end of the year.

I'm going to wait for the mailed RFE. If a 944 shows up without the colored slip of paper they're all expecting you're just asking for a lazy employee to chuck it in the reject pile, I think. Unfortunately given how backwards USCIS looks right now it's a lot harder for me to imagine the gains from sending in unrequested vs the losses.

When did you file the old I-765? My card was charged on Friday and I did not see any indication that mine was rejected yet (I sent the old one as well) so i'm wondering if they actually accepted it since I sent it the same day? I guess i'll see when I get my reciept numbers.

I got my reciept numbers today by calling USCIS so I'm sure that my payment will be posted any day. Just like I thought, my I-765 got rejected so I'll have the new form ready to go for when it arrives back. At least everything else was accepted so that's great news.

 

It says online "

On September 25, 2020, we rejected your Form I-765, Application for Employment Authorization, Receipt Number -------------, because you sent us the incorrect fee."

 

I assume that this is just what all of them says cause I certainly did not send them the incorrect fee and I used the group C9, it was an outdated form, lol.

 

Either way, at least I have the numbers now :)

OK so I just got off the phone with US CIS. What I was told is a whole bunch of people were incorrectly rejected. They advised me to wait for my i485 letter and to resubmit pretty much I suggested here. They said I could submit without it, but it would be better if I waited for that letter and I wouldn’t have to pay the fee.

Gotcha. We'll both just have the form ready to go once we recieve it back than. At least we wont have to pay the fee, even if we get it after Oct 2nd.

Does anyone else have this weird feeling of well I’m actually in the system now? 😂 I mean obviously those with K1s were before but even more so now
