I just looked at my I-765 form and for some reason I have a form that says  Form I-765 12/26/19 - OMB No. 1615-0040 Expires 05/31/2020.

 

I downloaded and filled this form/ stuff out in July.. I'm so confused right now why would the USCIS have a form that expires in May on their website after May.

You should be checking edition date on thee bottom of the form. USCIS doesn't follow OMB expiry date.

You should still be able to re-file the 765 without the fee if that happens, assuming the other apps are accepted. 

I sent our AOS package on 08/20/2020 and it was received according to fedex tracking on 08/25/2020, will I need to resubmit the work authorization?

I sent it Aug 6, 2020. On August 7, 2020, they received it and I got my NOA1.

Should be good. That's what i sent.

 

From USCIS website:

 

On or after Oct. 2, 2020, to apply for employment authorization, you must use the updated edition of Forms I-765 and I-765WS.

What to Know About Sending Us Your Forms I-765 and I-765WS
 
If you send the 12/26/19 edition (which is the old edition):

  • We will not accept this edition if it is postmarked on or after Aug. 25, 2020.

If you send the 08/25/20 edition (which is the current edition):

  • We will accept this edition if it is postmarked on or after Aug. 25, 2020.

If you send the 10/02/20 edition (which is the new edition):

  • This form has not yet published and is available in preview mode only, so you have an opportunity to see what it looks like.
  • We will not accept this edition if it is postmarked before Oct. 2, 2020.
  • This edition will be the only acceptable edition for forms postmarked on or after Oct. 2, 2020.

You're good. 12/26/19 edition sent before August 25.

I would say 90% chance that no, you will not need to resubmit. The thing stopping that from being a 100% chance is because you used FedEx, and not USPS. The rule USCIS states is 

 

"If you send the 12/26/19 edition (which is the old edition):

  • We will not accept this edition if it is postmarked on or after Aug. 25, 2020."

Only the USPS can give a piece of mail a postmark -- couriers like FedEx, UPS, DHL, etc. cannot.

 

USCIS stated policy with couriers for their fee changes is to go by the "receipt date" which is the date that the courier declares the package received (not the date it's ultimately delivered), which is usually the day you dropped it off or the day after. So your packet should be within the window, despite the package arriving on the 25th. If the employee who received your package was in a really bad mood they may reject, in which case you'll need to refile. But I think you said NOAs were coming in the mail for you, right? You'll know soon enough!

In other forums I saw (June/July) as early as 2 weeks after NOA date.

It depends on where you live and how big the workload is for your specific office. It's so hard to estimate sadly.

Well some good news. I talked to an agent via Emma and received my receipt numbers! The wait to connect with a live agent wasn’t too long, but it took the agent a little while to respond.

 

They would not give me the receipt number for the I-130 since I’m not the petitioner. Not sure how important that number is at this stage.

 

edit: I can figure out the I-130 number from the sequence. One odd thing is that when I check the case status online it says “received sept 1” but when I put it into myUSCIS it says received “sept 17”

Usually the receipts numbers for the cases is one after another. Try changing last 1 digit of the case number you have, In my case 4 of the receipt numbers are like: 4,5,6,7 (last digit)

Question, will I get a text for the I-130 as well even if my husband is my petitioner? The G-1145 we submitted have my info on it
