Tough situation! I agree that you should wait for as long as possible for them to process your package before sending in a second one (and only if USCIS tells you to -- I wouldn't do it without their go ahead).

 

If you end up going with mailing a second package, ironically I would recommend using USPS again, because this is the rule on the fee change:

USPS is the only carrier that provides a "postmark"  . FedEx / UPS / DHL cannot. So if you use a non-usps carrier, you'll have to overnight it end of week and cross your fingers that it actually arrives and gets processed by EOD on October 1st. There's usually a couple day lag between arrival and actual processing. You'll be cutting it close.

 

Whereas if you use USPS, you can wait the full 30 days for the original application to post, and then however long the transit time takes as well, for signs of life from your original application. Of course there's always the possibility that some careless lockbox employee doesn't look at the postmark date and rejects anyway, but I think the chance of that happening is lower than getting rejected for a late non-USPS carrier, and you'll have an opportunity to contest it.

 

Hopefully everything posts for you sometime this week/end.Really annoying. (I feel your pain on a much smaller level, USPS has lost my passport for the past 30 days and counting.)

That's a really good point actually. I'll consider using USPS again just to minimize the risk. Hopefully they're just taking their time processing my application. I'll have another application ready to go so I can send it off early next week with USPS since it will have been over 30 days at that point. I'll make sure to call USCIS and confirm with them at that point, though.

Thank you. This is just bringing me so much unneccesary anxiety so I hope that i can be resolved soon. I hope you get your passport soon too!

Just wanted to jump in the convo.

 

AOS filed 8/26

Delivered 8/28

 

Money orders have not been cashed yet. No other information. A bit nervous because sent in the old I-765 but hopeful that only that gets rejected and not the whole thing. Fingers crossed.

Some people are getting the whole package rejected and not only the expired form. So they will have to wait and see.

 

And no, they won't have to pay for EAD if their AOS was sent before Oct 2nd. Only people that file for AOS after that will have to pay for EAD and AP. Everybody that filed before that can still file for EAD and AP for free, including renewals.

Wait, really? I thought you had to pay the new fee if you send in the I-131 and/or the I-765 after then? That's great news though.

On the final rule, Table 4. They can't change the requirements for those who filed under the old law. The new fee only applies to people who files for AOS after Oct 2nd.

I live in Arizona too and I got my text messages on 09/13 but still no physical notices in the mail, it's been 9 days so I'm a little anxious..

If you check online status it would say "If you don't receive mail by <date>". So better to wait till date.

Oh yea it says by September 19, that's why I was thinking that maybe I should have contacted them.

Unless you want them to resend. I know people who got their text messages 9/3 and just received their notices last night

Well i think in that case you can request them to send a copy again. Good Luck. But since we all know USPS mails are delayed nowadays. You can wait till Friday. You already have receipt numbers and mailed copy doesn't really have anything else in it so i won't go crazy if i get them late.

I think it took Mary 3 or 4 weeks to get her paper copy for her ROC NOA.  And then they sent 2 copies.

I always received both. All emails go straight to the junk folder though.

For those of of us that have filed AOS in August without sending in Form I-944, looks like we will have to be sending in that form with supporting docs. DHS will now enforce the rule. See below. 

 

Alert: On Sept. 11, 2020, the U.S. Court of Appeals for the Second Circuit issued a decision that allows DHS to resume implementing the Public Charge Ground of Inadmissibility final rule nationwide, including in New York, Connecticut and Vermont. The decision stays the July 29, 2020, injunction, issued during the coronavirus (COVID-19) pandemic, that prevented DHS from enforcing the public charge final rule during a national health emergency.

Therefore, we will apply the public charge final rule and related guidance in the USCIS Policy Manual, Volumes 2, 8 and 12, to all applications and petitions postmarked (or submitted electronically) on or after Feb. 24, 2020. If you send your application or petition by commercial courier (for example, UPS, FedEx, or DHL), we will use the date on the courier receipt as the postmark date.
