Sounds like you don't need anything else on your plate! I wouldn't worry too much about the education, it's one factor of several. They probably just care more that the form is filled out and complete than anything else so they can check the box.

Honestly I think some of us will get through without the I-944 and some of us will be pulled up. I feel it is just going to be luck of the draw. I just checked the website and the form still isn't there?? Like, ok.

Obviously hoping it's never needed (we didn't include it), but the government has shown they are very committed to making 944 happen and I would not be at all surprised if the information is requested at some point in our journey...

This is the strongest indicator to me that it's not yet required on their end, regardless of what the employee said on the phone. USCIS has updated the site since the last court ruling and did not make a change to the injunction page or provide the form for download. They've done both in the past when they required the form.

 

It seems more likely to me that the employee was just as confused about 944 as everyone else and therefore said "yes, it's required" because the alternatives "I don't know" and "no" (if it ends up being yes) both make them look bad. No harm in saying yes (except making a bunch of people on the internet nervous! 😂)

 

With the exception of @KittyKat3072 's crazy quick turnaround (did you file with 944?), we're all still comfortably in the window for not seeing any activity yet...

Anything can happen with immigration procedures with USCIS. There is not black or white, but a grayscale: In my case, my husband and I filed concurrently I-130 and I-485, and included two checks. We did include the I-944 because we didn’t know that we didn’t have to include it. Anyway, USCIS received the package on August 1st. The check for the I-130 was cashed out on August 28th, but the check for the I-485 was not (and haven’t been cashed out yet). I chatted with them yesterday through Emma (Live Agent), because we thought they had rejected the I-485, but fortunately, a USCIS agent gave me the receipt numbers for both I-130 and I-485 and told me that they are experiencing delays (they accepted the I-485 on Aug 26th!), and for that reason, they hadn’t cashed the check for the I-485. Finally, they told me that we should receive the NOAs by the end of this week. And well, waiting also for the money to be withdrawn from the bank account for the I-485.

I am hoping that this is the case too - disconnect between the people who answer the phones and the people on the ground so to speak. It is confusing for everyone so I am hoping they got it wrong and logically you can't expect to receive a form that you aren't supplying but alas this is USCIS and they could do just that. I just want to see someone who applied after the rule was overturned get their check cashed without the inclusion of the form - I don't think there has been one yet?

If you are filling the I-485 using the code (c)(9), you don't have to pay for the fees for I-131 & I-765 (they are waived in this case). So you only need to pay for the I-485 ($1,140) and biometrics ($85), which totals $1,225.

 

If you're filling under a different category other than (c)(9) you would have to pay the fees for I-131 & I-765, making the expected fees higher than that.

 

That's why my first guess was this... you sent the payment with the correct amount, unless you stated on the form that you were applying for a different category (and not c9). I think that's the only field that directly affects the amount you pay when applying.

 

I don't think the problem (at least in your case) is due to the lack of form I-944. My packet arrived at the same date as yours and I didn't send the I-944 as well and my form was accepted. I would be really surprised if they would randomly reject different applications received on the same date based on that.

@partyintheUSA Yes I applied without the I-944! I send my AOS package off in July with it but got rejected and I resented it without the I-944. I got a text from USICS Sunday night with my case numbers! :)

I have got NOAs and Bio notices. Submitted in August without i944.

 

Oh yea, I called USCIS and spoke to two different agents before submitting. One said to submit the 944 and the other one said not to.

Hi, thank you for your reply! I did sent the I 944! So that’s not the problem. I did put in C9P as my category. So I believe the amount of 1225$ was correct! I am super confused and still waiting for them to call me back. This is so annoying!

How soon after your NOA did you get your bio notice ? Do you mind filling out your timeline to help others out please ? 
 

Also people, I would take what uscis call center representatives have to say with a grain of salt. We seem to know more than they do. Typical government employees. @cariger8989 gave us a perfect example here- one person said yes to submit I-944 and one person said no.
