Yes, I did mark the envelope with the name of the forms being filed. I still have no news from USCIS; no checks cashed yet, no NOAs mailed. It has been 25 days since they received the I-130 / I-485 package 😞

Do you need to send the I-944 if you have worked on-campus on your F-1? 

 

Even if I've been working as a Graduate student, I don't think I am exempted from filing I-944. I did it just to be safe

That's frustrating! One thing -- being in FL, it's possible your local office was hit extra hard by COVID and there are some increased delays as a result. I would give it another week and then see if you can request a status update.

Good news regarding the furlough!

 

As for the wait times, while I wouldn't be surprised if they increase, I also wouldn't be surprised if things run somewhat normally.

 

If you think about the politics behind all of this, the USCIS director pretty much has to put something "bad" in this memo, because they're in the process of asking for additional funding, and have already stayed furloughs twice now.

 

So it looks a bit like the "Boy who cried wolf" (I think this is a universal fable?)  if they keep postponing furloughs and saying nothing. But if they say wait times are going up, then people have a reason to complain to their elected officials, and those people can lobby for increasing funding and everybody "wins". 

 

Also, depending on who is in office in November, priorities could again shift. 

 

So I would stay positive. Our apps are in and as of next week there will still be some people around to read them, that's a good thing.

Right, I just meant since it is technically not required right now we don't NEED to do it so I was just curious about whether we still needed to file it or something/

Ok, I think I made a big booboo on my I-765 Form.  I used the category (a)(6) vs (c)(9) . What will happen now?  I will probably just get an RFE or something?  I've already mailed it so there is nothing I can do to change it now. :(

Sent off our applications just now. It’s late so post dates for tomorrow so I’m hoping no weird spur of the moment I-944 news tomorrow as I didn’t include them. It’ll arrive there Friday so now I’m nervous! Hoping it all goes well!

You'll be fine even if they come up with more nonsense your packet will be postmarked  before their nonsense. Good job I know you've been careful. No need to be nervous!

Our field office is Orlando. We are originally June filers but we were rejected.

I don't think you have to worry about an update to I-944 guidance tomorrow.

 

When the 7/29 court decision was announced, USCIS updated this page two days later (7/31): https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge 

 

That page was again updated on 8/21. There's no mention of the 8/12 decision that limited the injunction, and the injunction page itself https://www.uscis.gov/green-card/green-card-processes-and-procedures/public-charge/injunction-of-the-inadmissibility-on-public-charge-grounds-final-rule hasn't been updated since 8/4.

 

It's possible USCIS is just taking significantly longer to figure out what to say/do, but it seems more likely to me that they're waiting for something else to happen (my guess is further legal proceedings -- unless there's something I'm missing, I think it's still possible to appeal this decision). 

 

Even if they do change their guidance soon, I think the worst case scenario would be an RFE, not an outright app rejection. 

 

All that said, I was definitely refreshing the injunction page while waiting in line to drop off the package, so I completely understand the nerves :)

did you file I-131 and I-765 concurrently ?
