My wife wasnt asked anything about Public Charge. We just had her interview.

 

Of course we had the paperwork ready, but still.

 

We had a joint sponsor too.

So if I'm understanding correctly, the DS5540 isn't needed anymore now? That would certainly be great news. I'm still nervous if they may ask for it at the interview though. Should we fill it out anyways??

Our CR1 Journey:

 

USCIS Stage:

  • Feb 14 2019: NOA1 (NSC)
  • July 31 2019: I129f NOA1
  • Sep 19 2019: I129f NOA2 (Denied - 50 days from NOA1)
  • Sep 19 2019: I130 NOA2 (Approved - 217 days from NOA1)

 

NVC Stage:

  • Sep 27 2019: Sent to Department of State
  • Oct 31 2019: Case number received (34 days since sent)
  • Nov 1 2019: IV & AOS fees received & paid
  • Nov 14 2019: IV & AOS submitted
  • Dec 18 2019: All docs accepted, but one additional doc requested (5 weeks from submission)
  • Dec 18 2019: Requested doc submitted
  • Feb 19 2020: Documentarily Qualified (9 weeks from 2nd submission, 14 weeks from first submission)

 

Interview Stage:

  • Mar 11 2020: Interview letter received
  • Apr 1 2020: Interview date
  • Mar 17 2020: Interview cancelled due to COVID-19
  • August 3 2020: Rescheduled letter received, new appointment August 25 2020
  • August 25 2020: Visa approved at interview! (558 days from NOA1)
  • September 10 2020: Embassy received passport in mail
  • September 15 2020: Passport with visa in hand

 

October 11 2020: Arrived in US!

I already filled it out and because we have no red flags I'm taking it.  Easier to hand them something if they ask for it (which sounds like it is unlikely) then argue that they are wrong.  Do you really want to point out to the one person that holds your fate in his hands that he is wrong about his own job?  Just my thoughts.  Others might have a differing opinion.  

 

What exactly is everyone's problem with filling out the DS5540?  It's basically all the same info that you already provided.  Or are some just worried because their own case might be a little thin on money to show a solid DS5540?  If so, print the page from the government website.  If a solid DS5540 I'd bring it.

My lawyer asked me to bring 2017, 2018 & 2019 tax transcripts of my husband. 2019 is the online filing of extension. I clipped a copy of the 2019 extension filing to the i864 Form. At the Consulate, when I was asked to pass my documents, I handed my civil documents together with the i864 Form and the 2019 extension.

good luck to you! We didn’t have a “real emergency” but requested on the grounds that we were delayed by four months due to USCIS error and the beneficiaries career which is based on the US academic year.

I did an expedite I haven't gotten any response at all yet...

Dude we brought a mountain of and they didn’t need hardly anything more than the tax info, joint sponsor info, and marriage certs.

There's a guy in the Philippines forum who said his interview was just canceled due to unforeseen circumstances. I think what happened is NVC sent him that fake cancellation notice that they send to all expedites late. I PMd him. I really hope he sees my message because I really think his interview is still on. Would be such a shame if his wife missed it.

 

It really is absurd that NVC tells all expedites their interview was canceled with no explanation. It would be NVCs fault if they missed the interview.

Nvc has to go through the process of cancelling any interviews they may have programmed.  It's sort of protocol to send those automatic cancellation emails. The reason being is because once embassy accepts the expedite request , from there on the embassy takes over the case. NVC has nothing to do with the case anymore, except to transfer it. 

 

I know this because my wife got an expedite and I called nvc about that cancellation interview email and that's what the rep told me. Those are just steps the nvc has to take.

I just requested to expedite my case which is currently at NVC DQed. 
 

Subject Line: Expedite Request /Case # 
First paragraph: 

I introduced my self, name, date of birth, and where I reside. Same thing for the beneficiary (my husband). 

Second Paragraph: Reason/s for this request...

I also included attachments (Proof) 

 

At the end I made a pleading if you will. 
Asking for their approval for my request.
