You are in the US so not sure what you have to expedite.

https://www.uscis.gov/forms/forms-information/how-to-make-an-expedite-request. you can request expedited for all forms. cause i-485 cannot be approved unless i-130 is approved.

In your case, it isn't recommended to file I-130 online because if you file online you can't file the rest of the forms until you receive the I-130 receipt notice.

In general, send the following four packets in the same envelope:

  • I-130 with I-130A and copy of marriage certificate, filing fees, etc.;
  • I-485 with  I-864 and supporting documents, I-944 and supporting documents, electronic I-94 copy, filing fees, etc.;
  • I-765 with electronic I-94 copy, etc.; and
  • I-131 with electronic I-94 copy, etc.

I-130 and I-864 are signed by the US citizen. I-130A, I-485, I-944, I-765, and I-131 are signed by you. You'll separate each packet with rubber bands or fasteners: https://www.uscis.gov/forms/forms-information/form-filing-tips

 

On the I-130 packet, I-130 payment method (check, money order, or Form G-1450) must be the very first item of this packet.

On the I-485 packet, I-485 payment method (check, money order, or Form G-1450) must be the very first item of this packet.


Also, note that USCIS has a credit card payment option. So if you or your spouse have a credit card with a good rewards program I recommend paying with credit card. https://www.uscis.gov/forms/pay-a-credit-card In that scenario, it'll be 2 Form G-1450.

  • On the G-1450 for I-130 packet put I-130 Petitioner's name in the first row. G-1450 must be the very first page of this packet.
  • On the G-1450 for I-485 packet put I-485 Applicant's name in the first row. G-1450 must be the very first page of this packet.

Yes you start with the phone call on the 1-800 number. after that they will send you an email asking you to submit document evidence as to why you qualify for expedited request. once you submit the documents to the email address. they will make a decision.  they can approve or deny your expedited request. if approved,  your case moves to a fast express lane.

That's the official name of Advance Parole document. For example:

  • the Permanent Resident Card is officially called Form I-551
  • the Employment Authorization Document (EAD) is officially called Form I-766.

Usually, they issue EAD and Advance Parole as 1 document. It says "SERVES AS I-512 ADVANCE PAROLE"

Just to make sure because it wasn't mentioned before: Did you get married on this trip to the US? Because if you were already married then there might be some issues (at least in pre covid times, maybe covid changes that)

Preconceived intent to AOS? Intent is determined at POE, not at the I-485 interview. See Matter of Battista and Matter of Cavazos precedent decisions.

To the OP: if you choose to go the AOS route just know you can’t leave the country until your AP (advanced parole) document. So god forbid something happens to your elderly parents you either can’t leave the country to see them OR if you chose to you have to go through the process again while in Canada and will almost definitely not be able to visit the US. So it’s your decision if you are fine with not seeing your parents for approx 6 months.

We got married two years ago in Canada when we both lived together there. Petitioner is dual citizenship and moved to Florida because he is sick and need a medication that’s only offered in the US
