I wonder how we will handle this while working in USA? If the greencard expires, that means you are unlawfully working and living in USA until you get it renewed. But you can't renew it as a family based conditional permanent resident without applying for the 751 which takes over a year to approve, yet you can't apply for the 751 until 90 days before your green card expires. So we will be ineligible to work for 9 months and be unlawfully living here?? This has me concerned..

You'll receive an extension letter that automatically extends the green card while the 751 is being processed. So, the letter + green card = all good.

i also just read that if you don't get the letter before the 90 days, you make an infopass appointment for an i-551 stamp to extend your green card for a few more months. But according to this https://my.uscis.gov/en/appointment/v2 you can't schedule an infopass appointment at your local office anymore. You must send them a message and wait for them to respond.

No. The expiration date is just for the document. You are still lawfully here after that date. Your current employer can't fire you based on the document expiring: https://www.uscis.gov/i-9-central/complete-correct-form-i-9/completing-section-3-reverification-and-rehires

Employers should not reverify:

  • U.S. citizens and noncitizen nationals
  • Lawful permanent residents who presented a Form I-551, Permanent Resident or Alien Registration Receipt card for Section 2. This includes conditional residents.
  • List B documents

If you've filed I-751, then you also are not at risk of losing LPR status, even if they take a while to send you the extension letter. Losing LPR status is actually a lengthy process and you need to go to court for it to be official. People have even filed I-751 late (as in AFTER their original card expired) and most are fine so long as they provided credible reasons for filing late. So you're good.

A green card is evidence of status, not status itself. If your card expires, it does not mean you are unlawfully working or living in the US. That is a faulty assumption.

They will send an extension letter after filing the I-751. Currently, this extends the expiration date of the existing card by 18 months.

They generally won't issue an I-551 stamp beyond the date of your existing card when you are a conditional resident. You need to file the I-751 and get the extension letter. Only if that was stolen/lost/damaged, or the extension was about to expire, would they issue the stamp.

It's definitely a little confusing because it's technically different from AoS. The conditional resident is now petitioning to remove conditions from their status. AoS is the US citizen petitioning for the immigrant to be granted legal status. I too was confused haha! Good luck with sending it in amd don't forget to make sure your nails are clean for all the biting. (Bad joke, sorry....my nails are destroyed though and it hasn't even been a week since our package was delivered eeeek. 😬)
