RIFE income does not meet requirement

Why don't you use your Dad as joint sponsor instead? You fill out a 864 for him and a 864a for you mom. That's usually what most people do.

 

Your household remains 2 on your 864 and your dad will have a household of 4, including your brother and your spouse.

So by doing that they will not count my income right?  If I filed that i864a for my mom, then she will be related to sponsor as his spouse? I choose the other options because we can combine income together. Im afraid they said we dont have enough income

You have 5 people living in the same house. That doesn't mean you're all in the same household.

 

Your household: 2 = you and your spouse. 

 

Do you provide to your parents with more than 50% of what they have? You said your dad has his own income and file his own taxes, so your dad and your mom is in their own household.  If your brother is claimed by your parents on their taxes / his not independent yet, then your brother is part of your parents household, not yours. But if you claim him as a dependent, than he's part of your household. Or if your brother has his own job and file his own taxes (is not a dependent) then your brother is in his own household (3rd one).

 

After saying that you have a couple options:

 

1. If your current income is above the 125% threshold for your own household (2) than you don't need anything else. You will send your tax transcript for the latest year and send proof of your current income: paystubs, letter of employment stating your salary or yearly rate. And you will explain why in the past years your income wasn't high.

 

2. Using your dad as a household member. Since your dad lives in the same house as you, you can claim him on your 864 as a household member and his income will be combined with your to meet the 125% threshold. By doing that, you will only include your dad in your household size, not his whole household. Your dad will also have to sign a 864a and send tax transcript and w2, since he filed jointly.

 

3. Using your dad as a joint sponsor. With this option, the incomes won't be combined. Your dad would have to able to meet the 125% for his household + your spouse, a total of 4 if your brother is their dependent or 3 if not. With this option they won't look at your income but you still need to send your tax transcript.

This person is giving you very good advice. You are making this way too complicated. I suggest going with #1.

all of us dont have 1090 since we mostly is w2 employer


Was your brother a dependent on your fathers most recent tax return? If so, he's still a dependent for these purposes. Turning 18 doesn't make you a non-dependent.

I feel that you may be over complicating the household thing.

If you are using your own information without a joint-sponsor, then your household is 2.
If you are using a joint sponsor then when you fill out YOUR I-864, your household is 2 (You and your spouse). When your dad fills out his I-864a (along with other household members), his household is either 3 (Dad, Mom, and your spouse) or 4 (Dad, Mom, Brother, and your spouse) depending on if your brother was claimed as a dependent or not on the most recent tax returns.

Joint sponsor doesn't fill out 864a. Joint sponsor fills their own 864.

Yeah so now im doing i864 for me and 2 i864A for my parents, household will be 4. Is that good enough? 2 for me and my spouse and 2 for my parents. Do i need to include my brother in?

You need to read the instructions and the form to be able to calculate your household size. You keep asking if your brother is included in the household size.

 

You need to send what you want them to see. Overthinking and sending more than what's absolutely necessary won't help your case.

I read it over and over again but I’m not sure that why I asked. Thanks for the help 🙏 I will make it change

2. You didn't send a 864a for your dad since you included him as a household member (at least you didn't mention that).

3. If you sent a 864a for your dad, did you send tax return or tax transcript? If you sent tax transcript and didn't send w2, this would also trigger the RFE.

 

Any mistake on the form will automatically disqualify you as a sponsor, they won't even look at the documents you sent.

 

Also, DO NOT send past 3 years of tax transcripts. You're not required to do that. Only send the latest one. You're not even required to enter the amount for the other 2 years on question 24. You didn't have a good income before so sending that won't help you on anything.

 

 

This is super clear! I wish I had met you before. Sent tax account transcripts, ended with a RFE. Lesson learned!

Yeah I was trying to figure out what he was doing here. It looks like he was trying to count his entire household in his income, adding in I864s. Then it looked like he was going to use his dad as the joint sponsor so the mom needs to fill out the i864a (looks like I miswrote that uptop!), but then there was a back and forth on if the brother is a dependent or not and the confusion on who's household is what.

Just make sure you have ALL of the information right. It could have been a combination of a  number of mistakes on the form and from what you sent that got you your RFE.

I think that poster was backwards, tax transcripts are always better than tax return + W2 combo. Transcripts from the IRS are the ones you want to send.

Also, did you figure out what your households would be and what your fathers households would be?

I include dad and mom as household member not joint sponsor since we all live together and we can combine the income.
