i-864 - Tax return vs Transcript

Hello,

 

For my personal case, my spouse is using assets to meet the income requirement. 

 

 

But I'm curious if i'm including her return in addition to the tax transcripts??

 

 

Why does the i-864 checklist say:

 

For ALL sponsors: 

• A copy of your individual Federal income tax return, including W-2s for the most recent tax year, or a statement and/or evidence describing why you were not required to file. Also include a copy of each and every Form 1099, Schedule, and any other evidence of reported income. You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

The  i-864 instructions which say: 

 

Item Numbers 23.a. - 25. Federal Income Tax Return Information. You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years. You are not required to have the IRS certify the transcript or photocopy unless specifically instructed to do so by a Government official; a plain transcript or photocopy is acceptable. Do not submit copies of your state income tax returns.

Well, my wife (who is also my sponsor) sent only a photocopy of her last form 1040 together with the W-2s and so far we did not get a RFE and our case was approved (waiting for biometrics now)

 

We did not have co-sponsor, so in that case I don't know.

Similar situation as Juancarlos. 

Did not have access to the transcripts and simply sent a copy of the taxes with a cover letter explaining. All applications approved with no RFE so far. 

 

The main difference is that the transcript is usually only a few pages from the IRS so it is significantly less paper to sift through whereas the copy of the returns can be a pretty thick packet. If you have access to the transcripts, send those instead because you will end up sending much less paper.

Did your wife sent the complete tax return or it was just some pages ?

We sent the whole form 1040

Oh, I was told not to add the state's tax retund just the federal should I do that?
