Alright guys, here is a little update! In my last post said that I called VSC using the RFE trick but didn't work and I also said that I wasn't going to call customer service cause it's always the same bull.

Anyways, I couldn't resist! :blush: I just got of the phone with a really really nice lady who told me that my case is still pending (obviously) and that was recieved on may 9 but since they got A LOT of applications during may and june from ppl trying to avoid the increase of prices, it is delaying everything.

She said that normally K1's only take up to 3 month, maybe a little bit more but since my case has 4 months already and they recieved it on early may I should be getting an aswer in the next two weeks. She said if I haven't heard anything after two weeks, she told me to call back and they will help me out. She also thanked me for being patient and to wait a couple weeks. (wow, that was nice since I'm sick of waiting, hahaha)

I also asked if there's any way they will ask for evidence and she said that they usually ask for evidence at the begining of the process and if they haven't asked for anything yet up to this date, they won't because it will delay the process according to the time they gave....6 months.

Alright!! sooooooooo guysssssssss, if you're thinking they might ask for evidence, THEY WON'T!!!! It's too late for that!!! Erased that from your heads!!!!!

At least I got somebody really nice on the phone. The first time I called USCIS it was like a couple months ago and I got a really nice guy also, I think we almost cry together on the phone, he told me that he knows how I must be feeling, that it must be terrible to be away from my fiance, the person who I love and bla bla bla, hahahaha! When I told the whole conversation to my fiance, he asked me, Who did you call??!????? hahaha!

Well, now I can say that there are some people with feelings working at USCIS. hahahaha!

Anyways, this lady just gave me more hopes.....!!!!

Only one problem. It looks to me like the lady gave you bad information.

The USCIS clearly states that if there is a RFE, the 6 month service commitment clock does not start running until the requested evidence is received. You can read the text of the USCIS announcement regarding this here.

Because what you were told did not sound right to me, I looked at all K1 petitions sorted by NOA1 date and worked backwards from today to April 1 in order to see when RFE's were received.

I see lots of RFE's that were issued 2, 3 and even 4 months after the NOA1. This is consistent with how former adjudicator huskerkiev says that petitions are processed.

According to huskerkiev petitions are received, given a cursory inpection by a contractor and the check is cashed. Next they get put in a folder and the folders go into boxes with other petitions received at roughly the same time. Next the boxes are put into a line in the order received. There they sit until an ajudicator takes a box (hopefully the oldest) to his desk and starts working on the petitions in the box. If there are no problems, a petition can be approved in as little as 15 minutes! If the adjudicator needs more information, that is when the RFE is issued and the petition is set aside until the requested evidence is received.

My interpretation of all of this is that if you have not received a NOA2 or an RFE, it means that your petition has not been looked at yet or for some reason the adjudicator could not make a decision. If the petition has not been looked at yet, there is still a possibility of receiving a RFE.

The following data for the most part supports the way huskerkiev describes the process although there are a couple of exceptions. To read his posts, follow the link in my signature. It is very educational.

Yea, you're right, after I've been reading a lot of posts this afternoon and one couple was asked for RFE on their 5th month and also read in the USCIS website that after you sent in the RFE they asked the processing time goes back to cero, like if you were starting the process again but I also read that many people were asked for RFE and after they sent them in they got their NOA2's very fast....so you never know....

Maybe what she said it's a new rule, hahahaha! Since the already switch processing times to 6 months! ;)

Maybe I'm wrong but it could also happen that when you send your petition they take a quick look at it and if there's something missing, they ask you for RFE otherwise they just put it in a box and continue with what they were working. Who knows....

Agreed. The petition does not go back to the end of the line if there is an RFE. It sits on the adjudicator's desk and processing begins again when the requested information is returned to USCIS. Assuming that the information is provided quickly, the RFE will not consume a lot of time. There are lots of time lines that demonstrate that fact. There can be a problem however if USCIS cannot get the RFE mailed promptly. I have seen some timelines where that was a big problem.

What does get reset is the 6 month processing commitment. This will only come into play if your petition is older than 6 months and you contact USCIS for an explanation. If you received a RFE, the 6 month clock gets reset and they will tell you that you need to wait 6 months from the day your RFE response was received before you are eligible to make an inquiry.

Do you think it would be crazy of me to book February 23,2008 for our wedding day?? Approvals seems to be taking right around 90-120 days - and on the forms that go to the embassy in the SO's country it says have you made travel arrangements, set wedding dates etc. Also, the lady i am in contact with at the Embassy in Syria told me to let her know as soon as i've gotten approval and she'll keep an eye out for his file. Should I trust all of this?

Yes, I think it would be VERY foolish to book a February wedding. Why paint yourself into that corner? At least wait a while and see how the rate of processing looks 30 days from now.

I think it is a big mistake to assume that current average processing times will hold for anyone who filed after May. At this time the rate of approvals is horrible. Maybe it will improve soon, but maybe not. My advice is to wait and see before you make any committments.

I read somewhere, I'm sorry I can't remember where, that they don't make exceptions or hurry along for couples that have scheduled their wedding. When my fiance and I started the planning, we thought we would be married by the end of the year... and we're still waiting for our NOA2... HOPING. We haven't planned anything beyond location, which is completely based on this process and its flexibility.

Does anyone know if the any of the same people who can / do ajudicate passports...have anything to do or could ajudicate Visas?

It's a long shot I imagine, but I did read that as of today, that whole backlog with passport applications is now over, and...someone from the State Dept. said something about having to move ajudicators around, hire new ones, etc.

...Maybe I am just looking for a reason to think things will pick up again, but imagine if people from service centers were pulled or reassigned to cover the passport problem. I could totally see the government justifying that because, I mean, they'd be placing US citizens who need passports over people who want visas, cause they aren't citizens yet.

Again, maybe I'm completely talking nonsense...but I thought it was interesting.
