For example, I called VSC using the RFE trick yesterday and last week. Firs person I spoke with told me to wait a couple weeks. Then someone said they haven't received anything...even though it was sent from NY on nov. 9. Then another person told me that it is either on the mail room or not there. Yesterday and old man that I remember having spoke with him a while ago told me that it wouldn't hurt to resend it....Pat called yesterday and they told him to wait 60 days and that there are thousands of people behind me...as far as I know I'm one of the oldest ones and we cannot wait 60 days cause our deadline is on the 16. and they don't even know if it's there or not.

What do you guys think!?!?!? Confusing!!!!

Mirla, I think you should resend the copies of your RFE. I'm sure they want originals, but it can't hurt, can it? And this time overnight it with signature required and tracking and all that.

Then, I would put together a list of responses you can use. It seems the only thing customer service people are trained to do well is have the proper retort to get you off the phone. Try having the proper retort back for them. If they tell you / Pat to wait the 60 days, respond with, "We have a deadline of December 16th, we cannot wait 60 days". That sort of thing. Try going through what they have said to you and what you can say back, and try to have it in writing so that when the call is made, it's harder for them to give you the run around and just get you off the phone.

Thanks rae_aand_scott!!! We will send it again on friday or monday! I wanna wait a couple more days.

I did write a letter but I would also like a second opinion......can you guys helped me!?!!??? I think it is ok....

If you say yes, I'll post it here...hehehe!

Im almost sorry I called..... :crying: :crying: :crying:

I got Officer Nancy...who seemed nice but seemed to have a different story. When I called the other day, she said the adjudicator had gotten my case...would be ordering name checks which take a few days and I'll hear shortly after that. THen I get these touches.

NOW today she said he's had it since NOVEMBER 21. That the touch today was simply an update to some data in the system, and that I should call back in 30 days. Many there are on vacation and that some work slower than others (BY AN ENTIRE MONTH??? WHERES MANAGEMENT???) . That it could still be 30 more days.....Ok Im officially broken. No more positive, no more anything. I dont get it....how can it go from a few days, anytime to up to 30 more days????? And now she says the NAME CHECKS are the LAST THING before they issue an approval.....Thats not how it sounded the other day...Im sooo confused.

Please don't let customer service screw with your emotions. Calling them only makes this worse. For all you know she just had a bug up her ### today. Hang in there. Don't plug into anything they say. The guy yesterday told me they are only on May applications. They don't know what they are talking about and it will only make you feel worse.

You are going to get yours so soon!

Im wondering if she got monitored giving out information she wasn't supposed to....Casue I got what many here consider "the scripted" 30 days call back thing...but thats NOT what she said the other day....I know that if I dont have noa2 by my 6 month time...Im taking action..of some sort..

My advice to everyone is to ignore Officer Nancy and all the rest of them. They are incorrect at least 50% of the time. Why even bother talking to them? If you have a real problem or have gone over the 6 month processing commitment I would recommend going directly to your elected representative and/or the ombudsman.

Its just so aggravating to think that everyone depends so much on these idiots in customer service and it really seems like they really cant give any real info that its the same thing we see on the screen and nothing more!!!!!

Customer service really doesn't serve a purpose. Think about it. You cannot change your address through them, all they do is direct you to find the paperwork to fill out and send in either online or via mail. Forget about giving you any information on an RFE even though the prompt says "if you have a question regarding the information USCIS is asking for..." they will not tell you ANYTHING. As far as any other information about your case? No way. So what exactly is their purpose? Maybe they ought to do a story on this...think they did something called "The Fleecing of America" on the NBC nightly news. This would fit pretty well.

Damn! I just realized he's from August!!!! WOW!!!!!!!!!!!!!

Alright! Here is what I wrote!

Ref: Response to RFE date Nov 1, 2007 concerning Petition for Fiance EAC66666666666 sent back on Nov 9, 2007.

To Whom It May Concern;

The response to the Request for Evidence was sent on November 9, 2007, but up to today’s date, I have not received any notifications by e-mail or updates on the website stating that my response was received.

The Request for Evidence letter stated that my response must be received by Vermont’s office on or before December 16, 2007 and considering the fact that December 16 is in two weeks from now and that our response might have been misplaced on the mail.

I was advised by an officer from Vermont Service Center to resend my request for evidence response back and explain the reason why I am sending it again.

I am attaching the evidence that was requested with the copies of the original “Request for Evidence” letter.

I appreciate the opportunity to clarify this matter and hope your further consideration will generate an approval for this application.

Respectfully,

xxxxxxxxxxxxxxxx

What do you think? I kinda wanna add what you said, that they said to wait 60 days when I have a dec. 16 deadline

I think it's straightforward and that's definitely good.

The bold part is what I changed (simply b/c it wasn't a complete sentence).

I would advise not to add anything in the letter about being told 60 days, just to use that ammo for people telling you that on the phone.

Anyone else have suggestions?

---------------------------------

Maybe this instead?

December 16 is only a little over two weeks from now and we are concerned that our response might have been misplaced in the mail or otherwise lost by the Vermont Service Center, perhaps simply lost in VSC's own mail room.

Maybe that's too much. But they are the ones who told you it could be sitting there already, no?

The NOA2 that people keep thinking is August is actually a July file. It keeps people like him from being screwed by having to wait a month for NOA1.

NOA1 and Received date are too different things, and you are supposed to be put in line based on received date. I think that's only fair. He may be a little later in July than some, but it's still a July file.

All you need is a modest house in a modest neighborhood

In a modest town where honest people dwell

--July 22---------Sent I-129F packet

--July 27---------Petition received

--August 28------NOA1 issued

--August 31------Arrived in Terrace after lots of flight delays to spend Lindsay's birthday with her

--October 10-----Completed address change online

That's a good point.

It's just, emotionally, when we click on the timeline and see the August date, it's a bit jarring!

But you're absolutely right. :)
