hi guys,

im writing this here because most of my friends and family dont know that adriano is not in italy legally...they know he lives there and that hes albanian, but i never told them that hes there illegally because that sort of thing doesnt come up in everyday conversation...i spoke to him at lunch and i was really mad because he hadnt called me back when he told me he was going to (what a girl i am, i know)...and no matter how much i chewed him out about it, he just kept saying 'i love you, i love you, you're my life...etc'....this of course made me more mad because i thought he was just trying to sweet talk his way out of it...

so i called him a few times after lunch and his phone was off...i was getting really mad and also a little nervous...i called a zillion times and finally he answered...he was like 'i cant talk now' i said 'why?!' and he sounded all nervous he was like 'because im with the police'...all i said was 'oh nooooo, i love you' and he had to hang up...i dont know anything that has happened, and i can only assume that he is there because he has been living in italy illegally...i dont know when i will get to talk to him again, how long they will hold him for...if they lock him up or if they just send him back to albania....im so nervous and my heart is aching...

i know that people have a terrible image if illegal immigrants in their heads, but i want to make a few things clear...he is not a theif nor is he a criminal...he came to italy on a work visa which costs $4,000 to recieve and another $4,000 every time that he has to renew it (in his case it would've been every 3 months)...does that make ANY sense?!?! if one is coming to another country for work, 99% of the time it means that they have NO work in their home country....so he came to italy, overstayed his visa and never renewed it because he would be broke if he did so....he wakes up at 5 am and goes to work 6 days a week...he is a hard working and honest boy who is just trying to get by...he is my sweetheart....his heart is made of gold...i love him so freakin much and hope that we can still be together in america after this ordeal is over with...i dont know how this will affect the visa situation...of course its not IDEAL, but he was going to have his interview in albania anyway, so i PRAY that they just send him there and then everything will be ok...i dont mean to rant, and i know most people dont care about some illegal, but hes MY illegal and i want nothing more than to spend my life with him....if anyone has any ideas, please share...im trying to stay sane and i dont know who else to turn to

Hey Susie,

You know, actually one of my best friends here in NY is illegal. She came here legally but through all the red tape of trying to get a green card, is still without one after living in NY for almost a decade. I just wanted to say, sometimes these things happen, and not all people are going to make negative assumptions about illegal immigrants b/c the media would like us to.

The only advice I can give at the moment is try not to jump to the worst conclusions. I'm sure that's easier said than done, but right now you don't know what's going on with him, and there is really no point in giving yourself an ulcer thinking of all the worst things it could be. Just try to be patient until you hear from him.

Susie, Really sorry to hear about this mess. I hope it all works out in the end. If you were completely honest in your application, USCIS will no doubt know that he's been in Italy. because of his G325A form. And USCIS will no doubt know that he's been there illegally. I'm sorry to say that, but when they do a background check on his name and personal info they will find this out. He hasn't done anything illegal with the U.S. which is good, but I'm not sure how USCIS will view his history of overstaying a forgein visa. I'm sure he's a great guy with good intentions. And if the Italian authorities send him back to Albania, which they will most likely do, then he just needs to cooperate and hope that Uncle Sam doesn't ask any questions. If you do get lucky and USCIS approves your petition, then he must be prepared to answer questions about his past visas during the interview. The U.S. is getting very tough on visa abuse, I'm afraid. And that includes visas issued by other countries. But these are just my opinions. Perhaps there's a chance they won't even notice, but I kinda doubt it. Boy, i really hope everything goes good for you. Good luck! And I also hope you hear from him soon to know that he's ok. I know that must be your biggest concern right now. Keep us posted.....

according to the website of USCIS. :)

My birthday is Nov. 25, so this approval is a little early birthday present for me.

This afternoon before leaving work I decided to check on the US immigration website to see if anything had happened to our file. I saw it had been touched and immidiately called my fiance (yes it's 4 in the morning there) just to celebrate a touch.... then I clicked on our reciept number... and....

WE ARE APPROVED!!! We were approved on Saturday Nov. 17, 2007!!!

I am sorry to hear this news. My heart goes out to you.

At this point you need to hope that he has not been arrested. If he has, there will be no way to hide that fact from the embassy. The beneficiary must divulge all arrests on the DS-230 & DS-156K visa applications that are submitted to the embassy. In addition, they will probably require police reports for everywhere the beneficiary has lived for 6 months or more.

In addition, the embassy will look at the beneficiary's passport during the interview and see that he was in Italy on an expired visa.

I do not know if an arrest for illegal immigration or evidence that the beneficiary was in another country illegally are grounds for denial, but it surely won't help any. That is a question for an experienced immigration attorney.

Hi Susie-

Your post really got to my heartstrings... I can't say I know what you feel, but I know the fear that your loved one is in trouble, and I feel for you. Stay strong- he needs that from you right now. Is there anyone in his life there in Italy that you can contact to find out what's going on? I'm sure you've already thought of that... Maybe call his place of work? I suppose- that is if you speak italian... Good luck to you. I wish I had some good advice for you. I know it's hard, but try to stay positive- our minds always go to the worst place when we're worried... Try to stay strong, and wait it out. He'll call you when he can, and hopefully then you'll know the situation and things won't be all that bad. I'll keep you in my thoughts and prayers.

I have been checking this site for a few months, but my English is not good

so I have never posted comments before.

But I really wanted to tell everyone that I think I got the approval on Nov. 19

according to the website of USCIS. :)

My birthday is Nov. 25, so this approval is a little early birthday present for me.

I hope more people can get the approval soon.

mikimiki is another true July filer. Petiton sent on Jul 2 and NOA1 was Jul 6. They are also the first petition approved this week. :thumbs:
