Hello everyone, I have a bit of breaking news to share with you all.

I sent this email to CIS Ombudsman maybe a day or three ago:

Dear Mr. Khatri,

I write to you with a sense of urgency today. There is a new problem cropping up within USCIS in regards to the processing of I-129F petitions for K1 Visas.

Mr. Khatri, the service centers, particularly the Vermont Service Center, have actually processed several cases that are only a month or two old, from petitioners who have filed in the months of September or even October. While I hold no ill will towards these petitioners, I am slightly perturbed at the service centers.

We as petitioners have always been told that the service centers process on a 'first come, first serve' basis. It only makes sense that those who filed in June get approved before those who filed in July. However, we are currently just into November, and there are a multitude of petitioners from June, July (like myself) and August who have not seen any approval notices.

Mr. Khatri, we are starting to feel that we cannot call the service centers or USCIS for any information because any time someone calls, we get nothing but customer non-service, as representatives are clueless as to what is going on. Often these reps are rude and discourteous to discouraged petitioners who have no idea why their petitions are stuck in limbo.

Mr. Khatri, please do whatever is in your power as soon as possible to make sure this problem is rectified. As a petitioner who filed in July, I would like the system to work in the way it is supposed to be. June before July, July before August, August before September, and so on down the line.

Please get the Service Centers to get back in line, literally, in approving our petitions. It is bad enough that we have seen processing times spiral out of control. If we no longer have the order of months to go by, what else are we to do but cross our fingers and hope? With all due respect to you sir, that is unacceptable, and it needs to be fixed.

Thank you for your time, and please understand I direct no ill will toward you or your office personally.

Thank you again.

Sincerely,

Drew Joslin

Today I received a reply from the someone in DHS:

Mr. Joslin – The CIS Ombudsman shared your email with me. We do try to process fiancée cases on a first in – first out process. That being said, every case is somewhat different. Some cases are particularly well documented; in others there can be background or other issues that can affect how long the overall process takes. On a national basis the statistical average processing time for fiancée cases is 5.2 months, versus a goal of 6 months. Vermont’s timeframe has recently stretched to just over 7 months because of the surge of applications that we’ve recently experienced.

I would like to have our folks take a look at your case, which you indicated you filed in July. I’d appreciate any specifics, such as receipt number, that you’d like to share to help us in that regard.

The language you used in your email suggests this isn’t your first experience in filing a petition or application with us. I’d also appreciate any other perspective you’d like to share with respect to your past experiences.

So all you June, July, August filers, try to get the ear of this guy and see what happens!!

His email is michael.aytes@dhs.gov. I don't know if I should really share that, but that's the gentleman who talked to me! Use it at your own peril!

Hey, the Joz - Thanks for the4 info!! I somewhat pirated your letter, but made some pretty significant changes to it and fired it off to the ombudsman. I didn't feel comfortable using the name you supplied! I will let you guys know, what, if any, reponse I get. Lets keep on fighting!!!

Great effort in contacting the ombudsman.

I dispute the USCIS's claim that September petitions are being approved because they are especially well documented. That is just baloney. What could they have possibly submitted that allowed them be processed before May, June, July and August petitions? I can see that a petition without any complications would be processed before a more complicated petition submitted at the same time, but there is no way in the world that they should be even looking at non expedited September petitions yet.

When I wrote to the Ombudsman today, I pointed out that while there are different variables and nuances which may cause some petitions to be approved before others, I am highly skeptical that the 100s of petitons filed prior to Sept. 2007 are all of a more complex nature and less well documented than the few that have been approved after that time.

I addressed that in my email. I used joz's email and changed some things, added to make it more my own..and so we aren't just sending copy and paste emials...

Dear Sir,

I write to you today pertaining to an urgent matter I see starting within our Service Centers. There is a problem cropping up within USCIS in regards to the processing of I-129F petitions for K1 Visas.

I find that the service centers, particularly the Vermont Service Center, have actually processed several cases that are less than a month or two old, from petitioners who have filed in the months of September, and October. These particular petitioners I know for a fact were NOT expidited, were NOT Cuban beneficiaries and have no clue why after 2 short weeks had received their approvals. While I congratulate these petitioners, I am disturbed by this occurence that has taken place within the Vermont Service Center.

We as petitioners have always been told that the service centers process on a 'first come, first serve' basis. It only makes sense that those who filed in June get approved before those who filed in July. However, we are currently just into November, and there are many petitioners from June (me included), July and August who have not seen any approval notices.

Mr. Khatri, we are starting to feel that we cannot call the service centers or USCIS for any information because we are made to feel that we are a bother to them. the information we get is repetative and often wrong, misleading or just a brush off. Often these reps are rude and discourteous to discouraged petitioners who have no idea why their petitions are stuck in limbo.

Please do whatever is in your power as soon as possible to make sure this problem is rectified. As a petitioner who filed in June (EACXXXXXXX), I would like the system to work in the way it is supposed to be. June before July, July before August, August before September, and so on down the line. I do understand that each case is different and that based on background checks, documentation and completeness of the files, some may be adjudicated before others. However that does not explain some that are approved in October after just 2 weeks of waiting while June filers are JUST getting started with approvals. This makes no sense to me.

Please assist the Service Centers to get back on the proper time table for adjudication. It is heart wrenching enough that we have seen processing times spiral out of control while many other visa types, particularly the H visas, are approved in a matter of weeks. If we no longer have the order of months to go by, what else are we to do but cross our fingers and hope? I personally not only will wait up to 7 months for an approval, but add to that an extra 2 months until an interview and an average of 5 months of Administrative Processing due to my fiances' location. Thats a waiting period of 15 months or more!! With the deepest of respect, I must say this process needs fixed as soon as possible to minimize the impact on families.

Thank you for your time we appreciate the hard work you do, and hope that we can continue to bring our concerns to you for your immediate attention. If I can be of further assistance please feel free to contact me by email or at 804

Thank you again.

Sincerely,

Faith P. Keenan

I'd say if we all keep emailing today...he will get the message loud and clear..that this isnt' acceptable. someone out in the public KNOWS and SEES what is going on....

LOL No kidding!!! I studied for over a year in preparing to file! It was well organized and well documented!! I dare an adjudicator to dust it off and take a look - its all there!!!

We all need to keep pounding the ombudsman with this info and have our concerns addressed. Hopefully we can make a difference!

I have a question and lets see if someone has an idea. On my NOA 1 it says that my application is at VSC but I live in Florida and I sent it to TSC. Well my question is that I just checked on the timelines here on this site and there are some people that have been getting NOA 2's from TSC. Is that from the people just not changing where their process is taking place or is TSC still adjudicating applications?

Our Timeline:

Guy was on vacation Val was living there.

Mar 06 - Guy went back to London

Mar 06 - Val came to stay with me in Greece where I was living.

May 06 - Val went back to London

July 06 - Val came back to Greece and stayed until Oct 06

Oct 06 - Val went back to Brazil

May 07 - Val tried for tourist visa to U.S. DENIED!!!
