Waiting for a NOA2 from VSC for your I-129F?

I just had a bad thought. You know how some of those who already have their visas can´t seem to get along with those of us who are tired of waiting? It all seemed so childish to me. But in light of the paragraph that follows, it appears that maybe we should be the ones who are annoyed. Those SOB´s took our adjudicators! :ranting:

¨The Application to Adjust Status (I-485) will have first priority because USCIS needs to ensure that these applications are receipted in a timeframe that would allow processing of an application for an Employment Authorization Document (EAD) within 90 days of filing as mandated by law [8 CFR 247a.13(d)]. Our second priority will be to receipt the Application for Naturalization (N-400) so that we can minimize any delays in obtaining citizenship. USCIS is working to ensure all Applications for Adjustment of Status (I-485) are receipted and any accompanying applications for employment authorization documents (EADs) are processed within 90 days. USCIS is realigning its resources to meet this deadline.¨

It's not their fault, it's the USCIS's poor managment that led to this.

I'm annoyed with the behaiviour of those guys myself, but let's not ourselves start acting the same.

OK, once again a wink is too subtle. I will need to try really hard to remember this in the future.

To all, please be so kind as to let me clarify something. I did not intend to suggest that we should really be angry at people in the AOS stage because USCIS and/or VSC appear to have given them higher priority than K1´s & K3´s. I thought that the obvious foolishness of that reaction combined with the wink would make that apparent. However, I need to be more careful and realize that humor that consists of outragegous statements follwed by a wink to indicate that I am not serious does not work very well on a message board. I sincerely apologize to anyone who thought I was serious about being angry.

The important fact that got lost in my post is that in addition to having lost adjudicators to employment based petions we have also lost them to AOS & naturalization applicants. This is a new piece of information we did not have before. I was hopeful that VSC would work through the July employment based surge by the end of September. However at this point I have no idea when things will be back to ¨normal¨.

The N-400 naturalization applications are not listed on the processing time / service level USCIS page so I have no idea what that situation is. As to the I-485, the latest VSC report of September 15 shows that they are working on July 24th 2006 I-485´s while on CSC´s page they show they are in compliance with the 6 month I-485 service level commitment. I have no idea how long it will take VSC to catch up on I-485´s. The July 24, 2006 date is probably misleading but they are obviously in violation of the 6 month committment which will take them back to at least petitions from March 2007.

At this point I am becoming seriously concerned that we will not get our adjudicators back until VSC is about to go into violation on the I-129F 6 month service level committment.

Sorry to be negative again, but I try to deal in facts and not hopes, feelings or premonitions. When the facts are negative my posts will be negative. When the facts eventually turn positive so will my posts.

I know some people get annoyed with me because I am always negative and rain on their parade. I do not intend to do that, but I do feel obligated to point out when the euphoria and confident predictions that sometimes erupt are not justified by the facts. The same applies to the wails of doom that also sometimes occur, often from the same people who were on cloud nine the week before.

As to the positive reports from USCIS agents that an approval of a particular petition or group of petitions is imminent, well I am definitely old school. I will believe it when I see it. I very much hope that they are right, but I have little confidence in USCIS agents. Based on what I have observed so far, I doubt seriously if they have the expertise or computer capability to make such projections. As far as I can tell, there is no way for them to determine the status of a petition post NOA1 until it is taken out of the box and adjudication begins. Even then, they have no way of telling how long adjudication of a given petition will take. For some it is 15 minutes, for others it is 15 weeks. I suspect that agents are looking at some general reports and probably do not have any better information than we do on VJ, and perhaps our information is better.

The facts are that VSJ has approved 1 VJ K1 petition since September 18th and that was filed on 5/22. Does that mean that there is a box of late May petitions on an adjudicators desk? Yes, I think it does. Does that mean that all VJ May filers will have their approvals soon? Nope. The facts do not support that conclusion yet. It may be true. I hope it is true. But until I see evidence that VSC is regularly approving petitions I will continue to take a wait and see attitude.

Now if you will excuse me I need to try to get some sleep. I have been up most of the night with the very unpleasant effects of a food poisoning. Maybe eating chinese food in Bogota was not such a great idea. :wacko:

I did a quick peek at numbers: :whistle: :whistle: :whistle:

over the last 6 months VJ'ers with CSC numbered 650 (including nebraska and texas) while VCS only took in 145 K1 Petitions. That means that us VSC'ers only make up approximately 18.5% of the K1 petitions filed on VJ. With THAT in mind its easy to see why VSC may have received a bulk of back work.

Uh oh. Another statistics freak like me. ;)

Since we do not know how many adjudicators there are per petition in each center we can´t really reach many conclusions based on how many VJ petitions are in CSC and VSC. For example, if CSC has 10 adjudicators for 650 petitions and VSC only has 2 for 145, the CSC workload is actually lighter. (65 petitions per adjudicator in CSC vs 72.5 in VSC)

A better indicator that some sort of adjustment was warranted is probably the fact that earlier in the year VSC processing time was significantly less than it was for California.

The number of CSC vs VSC VJ petitions is a good indicator that the rate of VJ approvals per day should be higher at CSC since they have more VJ petitions. Of course that is not to say that VSC should be performing at their current miserable rate.

I am still confused by the reference to bulk petitions in your earlier post. I have never heard that term used in relation to a petition or application. The agent may have simply been referring to a large quantity of petitions and applications and selected a less than ideal word to describe it.

Is it possible for you to contact the agent you soke to again? I am eager to learn exactly what she was trying to say when she referred to bulk petitions. I realize it might be impossible to reach a particular agent.

Well, bulk could mean either....Either way...they have a back log...weather it was a "bulk" they recieved from CSC or a Bulk that came in from individuals that overwhelmed them...who knows...

Either way...the process will happen for us..just a matter of time. They have to get to our petitions sooner or later...I'd like to see sooner...but God has His own timeline in store...so...here we sit and wait...I was just happy to get more than a canned response..which I still think is improvement...an d this was the actual Vermont Service Center I spoke to

I did a quick peek at numbers: :whistle: :whistle: :whistle:

over the last 6 months VJ'ers with CSC numbered 650 (including nebraska and texas) while VCS only took in 145 K1 Petitions. That means that us VSC'ers only make up approximately 18.5% of the K1 petitions filed on VJ. With THAT in mind its easy to see why VSC may have received a bulk of back work.

Uh oh. Another statistics freak like me. ;)

Since we do not know how many adjudicators there are per petition in each center we can´t really reach many conclusions based on how many VJ petitions are in CSC and VSC. For example, if CSC has 10 adjudicators for 650 petitions and VSC only has 2 for 145, the CSC workload is actually lighter. (65 petitions per adjudicator in CSC vs 72.5 in VSC)

A better indicator that some sort of adjustment was warranted is probably the fact that earlier in the year VSC processing time was significantly less than it was for California.

The number of CSC vs VSC VJ petitions is a good indicator that the rate of VJ approvals per day should be higher at CSC since they have more VJ petitions. Of course that is not to say that VSC should be performing at their current miserable rate.

I am still confused by the reference to bulk petitions in your earlier post. I have never heard that term used in relation to a petition or application. The agent may have simply been referring to a large quantity of petitions and applications and selected a less than ideal word to describe it.

Is it possible for you to contact the agent you soke to again? I am eager to learn exactly what she was trying to say when she referred to bulk petitions. I realize it might be impossible to reach a particular agent.

Well, bulk could mean either....Either way...they have a back log...weather it was a "bulk" they recieved from CSC or a Bulk that came in from individuals that overwhelmed them...who knows...

Either way...the process will happen for us..just a matter of time. They have to get to our petitions sooner or later...I'd like to see sooner...but God has His own timeline in store...so...here we sit and wait...I was just happy to get more than a canned response..which I still think is improvement...an d this was the actual Vermont Service Center I spoke to

HMMMMM... maybe there is a pattern here -- maybe the domestic checks are taking longer than international background checks?! Maybe applicants who have worked here before are taking longer because of the beaurocracy?

I am trying to find some method to this madness. :rolleyes::)

I'm really starting to freak out. Did I sing everything correctly? Is it because D already has worked in the US before and has a social security number already? Is it because he recently got his J1 waiver.

UGH... the possibilities are endless... what did I do wrong?!!!! :unsure:

I'm sure everyone has felt this way at one point, right?

I also have one, I put it on the app and sent a ocpy of my wohle passport. On 2004 I was in California doing an internship....

If you didn´t they will ask you, right? I don´t think it will be a problem...

Don´t worry they know everything, that he had a J1 like me and was working....

Yeah, you´re freakin out! hahaha!

Question, why did he get a J1 waiver???

Day One: Went to Council of Elrond. Was prettiest person there. Agreed to follow some tiny little man to Mordor to throw ring into volcano. Very important mission - gold ring so tacky.

Day Six: Far too dark in Mines of Moria to brush hair properly. Am very afraid I am developing a tangle.

Orcs so silly.

Still the prettiest.

Day 35: Boromir dead. Very messy death, most unnecessary. Did get kissed by Aragorn as he expired. Does a guy have to get shot full of arrows around here to get any action? Boromir definitely not prettier than me. Cannot understand it. Am feeling a pout coming on.

Frodo off to Mordor with Sam. Tiny little men caring about each other, rather cute really.

Am quite sure Gimli fancies me. So unfair. He is waist height, so can see advantages there, but chunky braids and big helmet most off-putting. Foresee dark times ahead, very dark times.

April 30th 2008 - Flying home at last!!!!! (POE: Dulles - Washington DC)

July 12th 2008 - Wedding date!

Now for AOS!
