Just wondering if anyone out there has ever been denied AOS once here on a K-1 visa. If yes, why?

09/20/05 I-129F Sent to VSC

09/23/05 NOA1 email

09/29/05 NOA1 "snail mail"

10/04/05 NOA2 email

10/11/05 NOA2 snail mail

11/03/05 Not sure when, but it arrived at Juarez

12/19/06 Packet 3 arrives at US address

2/23/06 Interview @ Juarez

2/23/06 Receive Visa

2/25/06 Arrive in USA - temp EAD issued at JFK

3/17/06 Received Social Security Card

3/18/06 Married

3/31/06 AOS packet sent to Chicago

4/6/06 AOS packet received @ Chicago

4/10/06 NOA1 for AOS, EAD, AP received

4/19/06 Biometrics

6/16 EAD approved via email

6/20/06 AP Document received

6/24/06 EAD card received

6/27/06 Appointment letter for AOS interview

8/23/06 AOS interview - approved pending FBI name check

8/30/06 AOS approved - via email

9/7/06 GREEN CARD arrives

Yes it's happened, I've seen some posts on this forum to that effect. Usually for things like incomplete paperwork, missing the interview because you didn't get the interview appointment letter, and in one poor person's case, for not having enough evidence of the marriage (although that sounded like a bureaucratic snafu).

Most of the time it happens because of some sort of beaurocratic bungling and sometimes it's able to be sorted out successfully (for example, if your interview letter was undeliverable so they closed your case because you didn't show up at the assigned time)... However it's a very rare occurrence so I wouldn't worry about it unduly. If you got your K visa without a hassle the odds are extremely high in your favour that you won't have any problems with AOS either.

STAGE 1 - Applying for K1 (15 September 2003) to K1 Approval (13 July 2004) - 9 months, 29 days (303 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

STAGE 4 - CITIZENSHIP (filing under 5-year rule - residency start date on green card Jan 11th, 2006)

*N400 filed December 15, 2011

*Interview March 12, 2012

*Oath Ceremony March 23, 2012.

ALL DONE!!!!!!!!

yep.. it happened to us. Due to paperwork that a doctor submitted that was on the wrong form and signed by the wrong person. We filed a motion to reopen and it looks like it's finally straightened out.

March 4, 2004 NOA 1

June 29, 2004 NOA 2

August 26th -- interview date - we need to complete a I-601 waiver so it's back to waiting again

January 6, 2005 i-601 waiver approved!!!!

January 21, 2005 VISA IN HAND

February 12, 2005 WEDDING!!!!!

March 10, 2005 mailed AOS and EAD applications to Chicago

April 18, 2005 EAD and AOS receipt dates for NOA

June 30, 2005 AOS RFE evidence submitted (translated birth certificate)

August 10, 2005 ---EAD approved via infopass appointment

October 18, 2005 - AOS interview in St. Louis - received an RFE for vaccination supplement

February 9, 2006 - denial for AOS letter due to the wrong form being submitted from the doctor. PLEASE MAKE SURE THIS DOESN'T HAPPEN TO YOU!!

February 16, 2006 - USCIS accepts the motion to reopen without an additional fee - finally something goes right! We should hear from USCIS St. Louis office within 2 weeks.

April 3, 2006 - Received welcome to America letter in the mail!

April 8, 2006 - Received GC in the mail - done for 2 years!!!!

March 1, 2008 - mailed off I-751

March 3, 2008 NSC delivery confirmation

March 10, 2008 NOA 1

March 28, 2008 Biometrics appointment

Legal Permanent Resident - just waiting for time to pass for him to have eligibility for citizenship.

I was denied because my ex-husbnad refused to go to the interview.

Filing I 360 3rd Nov 2005

Prima facie determination received from Vermont 20th Nov 2005

DIVORCED JANUARY 25th 2006

EAD applied for again (jeez I need to work ) 28th Feb 2006

Removal hearing July 12th 2006

RFE's received for I360 and EAD 13th October 2006

NOID received March 2007

EAD denied March 2007

Back to Immigration Court April 18th 2007

NOID request for evidence received USCIS 3rd May 2007

I 360 touched May 31st 2007

I 360 actually approved May 30th 2007

EAD filed June 23rd 2007

I 485 filed July 24th 2007

NOA1 for I 485 August 1st 2007

EAD approved August 6th 2007

Medical with CS August 28th 2007

Biometrics August 24th 2007

Paperwork sent to Immigration Judge to finally terminate removal proceedings September 10th 2007

 

GREEN CARD FINALLY APPROVED AFTER 4 YEARS September 9th 2008 :D

 

N-400 Filed online 03/04/2018

NOA online 03/05/2018- projected Citizenship completion date December 2018
