My husband's AOS packet was rejected - "based on the information you provided your priority date could not be established"

 

We submitted the i-129f approval notice NOA2 with the packet, but there is no priority date so i don't know what they want.  What do we do? Just file i-130? I'm so confused because i thought we didn't have to file i-130 with K1

I-751 Removal of Conditions Timeline:

April 15, 2023 Mailed via USPS

April 17, 2023 Delivered by USPS

April 20, 2023 Received text message with case number (IOE)

April 22, 2023 Case status updated to "My Case is Being Actively Reviewed by USCIS"

April 27, 2023 Received two letters 1) Notice to set up online account 2) Notice that Biometrics will be reused

May 1, 2023 Received 48-month extension letter

August 20, 2024 Approved

 

N-400 Application for Naturalization Timeline:

May 5, 2024 Filed Application Online

July 12, 2024 Interview Scheduled

August 19, 2024 Interview Completed

August 19, 2024 Placed in line for oath ceremony

October 4, 2024 Oath Ceremony

You probably filled out something wrong on the form. The sentence you quoted is not the reason for your rejection, it's the consequence of your rejection.

 

- Check the form editions.

 

- Check the answer on part 2, question 2 of form 485.

 

- Check if you sent all the required forms, 864, 944.

 

- Check the category for EAD form.

 

- Check the payment amount.

 

If everything you sent is correct then it was their mistake and you just need to resend everything.

My best guess, if you filed application along with K2, the reason got rejected is you didn't include a separate I-864 for K2 and you put the total amount fee in one check, so they just rejected the whole package for both K1 & K2.

it needs to be 2c. Many people choose 2a which is a mistake.

Sierrandani,

 

The good news is that your application was only rejected -- not denied.  So when you receive the package back you just need to fix the Question 2 problem on the form and send the whole package back to USCIS.  And the package will already be two-hole punched and in the order USCIS wants, so insert the corrected 485 page and sent it back in the exact same order.  A loss of some time, but otherwise not a disaster. 

 

We had a similar problem on the original 129f when our fee check (a credit card convenience check) was rejected.

I also used all same paperwork, just replaced whole 485. Kept check same too as it’s valid for 6 months and by time I got package back, it was just a month done. Make sure to follow directions that came with package that was returned (having the green paper on top to let them know it’s re-submission of returned paperwork).
