K-1 Interview Completed - Administrative Processing - Bogota, Colombia

awesome man thanks for sharing this is some valuable info I’m not even close to the interview... I just filed my case and I believe California is reviewing my case. I hired an attorney to help me with this process and he’s gathered up all my documents and organized everything. The only issue is he wants me to hire another attorney to do the waiver process because my fiancé had gotten banned from the US so I guess she is suppose to ask them for a waiver to waive the ban that happened a couple years ago... I was under the impression the attorney I hired would do EVERYTHING. Now I have to pay more money is this common ?

Hiring attorney is not the only option BUT before I would hire one I would educate myself as to the entire process. You just may find out that you can do this yourself.

Our visa has been at the consulate since March 2020 we have also not received instructions. I've read many have not as well and have gone ahead and scheduled interviews. I see you did that. It was not a big deal to schedule an interview without the instructions packet? They allowed the interview to happen without any issues?

What I discovered is that the embassy really does not care about our cases, and if we are not following consistently, they will disregard our needs. When my girlfriend gave her e-mail address, the e-mail address was off by 1 letter, and therefore, the email from NVC went out on December 16, 2019 to the embassy, but she never received an e-mail with instructions. Every time I tried calling, they never gave me a clear answer. It was not until January 09, 2020, after questioning why the CEAC site gave me certain information and why I was not seeing any physical movement, that I finally got an agent in Bogota to schedule an interview. Because we never received actual instructions via e-mail, my girlfriend did not have her medical paperwork ready. The point here is, don't rely on good communication from the embassy and always try to push your case. Keep good track of all your e-mails.

Hello, today I checked my case status in CEAC and I received the following message:

Your case has been returned to the National Visa Center (NVC). Please contact NVC for further information. http://nvc.state.gov/ask
For more information, please visit TRAVEL.STATE.GOV.
 
I was wondering what this means. Can anyone please help?

Your file is being return to NVC who in turn will send it to USCIS for their decision. Normally you will receive a NOIR (Notice of Intent to Revoke) after a denied visa interview or your NOA2 expired and therefor your case is now be returned to NVC.

 

In K-1 cases one of three things will happen.

  • USCIS feels the consulate is unfounded in denial, they will reaffirm petition and send back for another interview, sending you a letter they did this.
  • USCIS decided to administratively close the petition, considers it expired, they send letter stating to try another petition either get married or try another K-1
  • USCIS sees the inadmissibility and revokes the petition, this is the BAD one, you need to address the revocation with evidence, I would get a good lawyer involved with this

With the embassy and NVC (DoS) the will say it is out of thier hands and in USCIS's hands at this point and this activity can take months or more to get the letter from USCIS stating how they will handle it. 

 

The beneficiary should have been provided a document by the consulate stating the general grounds for denial. I advise that you be prepared to rebut if the opportunity exists (the letter from USCIS will explain your next steps).

 

No one can say how long it will take but expect upwards of 6-12 months maybe more.

 

If you receive nothing from USCIS use these forms:

 

Use our online FOIA system to request: Your own immigration record, Another person’s immigration record, or Non-A-File information such as policies, data, or communications.
 
Use this form to request the return of original documents submitted to establish eligibility for an immigration benefit.

You are awesome. Quick question, I think that the NOA2 would have expired. I read the following:

The I-129F petition is valid for four months from the date of approval from USCIS. The validity of the I-129F petition is routinely extended by consular officers to ensure that applicants have sufficient time to complete the processing of their case.

 

I guess that I have to wait for notification from USCIS to see what actually happened.

A fiancé visa must be issued within four months from the date of approval of the fiancé petition by USCIS (U.S. Citizenship and Immigration Services). If your appointment is later then the validity date, bring a signed and dated letter from your U.S. fiancé(e) stating that you both remain legally free to marry and that you intend to get married within 90 days of your arrival. E-mail or copies are acceptable.


9 FAM 41.81 N6.2 Validity of a K-1 Petition
(CT:VISA-2165; 08-21-2014)


An approved K-1 visa petition is valid for a period of four months from the date of USCIS action and may be revalidated by the consular officer any number of times for additional periods of four months from the date of revalidation, provided the officer concludes that the petitioner and the beneficiary remain legally free to marry and continue to intend to marry each other within 90 days after the beneficiary's admission into the United States.

I think it will be awhile.  The NVC just received your file last fall  in 2020 and it was never received by the embassy.  There are people that had interviews cancelled in March of 2020.
