I-130A - Do I need to sign as the preparer, if I'm the petitioner?

Hi,

 

I'm currently filling out the I-130A (Supplemental Information for Spouse Beneficiary) and I'm a bit confused. My spouse is currently overseas and I know that she does not need to sign the I-130A because she is overseas. However, I (Petitioner) am doing the I-130A for her, now do I need to sign the I-130A on Part 6 where it says 'preparer' on her behalf since I'm doing it for her?

Yes, you are the preparer and you need to fill out your information.

Now my other question is that when I was about to sign it - preparer's part - I was reading the disclaimer first but then something caught my eye. It says on the disclaimer - THE SPOUSE BENEFICIARY THEN REVIEWED THIS COMPLETED FORM AND INFORMED ME THAT HE OR SHE UNDERSTANDS ALL OF THE INFORMATION CONTAINED IN, AND SUBMITTED WITH, HIS OR HER FORM, INCLUDING THE SPOUSE BENEFICIARY'S CERTIFICATION....... 

 

So what is the SPOUSE BENEFICIARY'S CERTIFICATION? Picture is attached for reference.

This is talking about the part where she signs the form. It’s making sure that you have explained her fully what she is signing any why and that she is aware of the consequences of providing false or misleading information. Basically they are reminding you to make sure you have explained everything to her. That way she can’t use the “i didn’t know that I was signing” argument if there is a problem.

Timeline

Not everyone fills out the preparer part even though the beneficiary didn't fill it out (I'm not saying to do that).

I filled it out. If you do it online you need to print out that page and scan it.

It's especially important to fill it out if there's a language barrier, because then it's more obvious that someone helped.

I'm more savy in this stuff anyway so I'm handling all the paper work.

But remember this part.

"If your spouse is overseas, Form I-130A must still be completed, but your spouse does not have to sign Form I-130A."

Mucho gracias! Now that everything is all cleared up I will be sending my I-130 package this Monday and will start tracking it on my timeline! 👍

Thank you thank you! Will send my package on Monday now that everything is all cleared up! Will start tracking it too on my timeline. Thank you again for your response/help.

I see. Just read it now. We skipped that part as we didn’t need a preparer’s help. Thank you!
